ORDINANCE NO. 364

TITLE: AN ORDINANCE AMENDING SUBSECTION B.l.a., CONCERNING
PERMITS, OF APPENDIX A, SECTION 24, ZONING ORDINANCE,
OF THE CODE OF THE CITY OF WHEAT RIDGE, COLORADO, BY
THE ADDITION OF A SUBPARAGRAPH (4).
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. Subsection B.l.a. concerning permits of Appendix
A, Section 24, Zoning Ordinance, of the Code of the City
of Wheat Ridge, Colorado, is hereby amended by the addition of
subparagraph (4) as follows:
Sec. 24. Excavation and deposit control.
B. Restrictions. Such operation within any district shall
be restricted to the following:
1. Deposit or extraction of earth, sand, gravel, rock,
minerals or other similar resources, and/or storage
thereof, subject to the following conditions (in cases
of isolation or unusual characteristics of the operation
or the location thereof, amendment of these requirements
may be made by special permit):
a. [Permit:] Subject to obtaining a permit through
the planning department prior to any operation of
this nature which shall be issued upon receipt
of:
(1) Number of acres involved and acceptable
legal description of site.
(2) Name and address of property owner(s), and
lessee, if any.
(3) Site plan indicating all proposed or existing
access or egress ways.
(4) No permit shall be considered until any violation
that exists at the time of application has been
corrected. This means specifically that any fill
material deposited upon property in violation of
this ordinance prior to the issuance of a permit
shall be removed, and the engineering department
must certify that the removal has been complete,
before application for such permit shall be
considered.
Such permit shall be issued only upon receipt of
proper bonding and insurance requirements as required
herein.

Section 2. Severability. If any clause, sentence, paragraph,
or part of this ordinance or the application thereof to any
person or circumstances shall for any reason be adjudged by
a court of competent jurisdiction invalid, such judgment shall
not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 3. This ordinance shall take effect
after final publication.

6 to 0 on this 24th day of September , 1979;
ordered published in full in a newspaper of general circulation
in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for October 15, , 1979, at
7:30 o'clock p.m., at Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final
reading by a vote of 6 to 0 this 15th day of
October 1979.
