HomeMy WebLinkAboutOrdinance-1979-0370INTRODUCED BY COUNCILMEMBER LEWMAN ORDINANCE NO. 370 Series of 1979 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM AGRICULTURE- ONE (A-1) TO COM1IERCIAL-ONE (C-1) FOR LAND LOCATED AT 9990 West 49th AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application of C $ H Development Company for approval of rezoning in Wheat Ridge Case No. WZ-79-38, and upon recommendation for approval from the Wheat Ridge Planning Commission, and pursuant to findings made based upon testi- mony and evidence presented at public hearing before the Wheat Ridge City Council, Wheat Ridge Zoning Maps are hereby amended to exclude from the Agriculture-One (A-1) Zone District and to include with the Commercial-One (C-1) Zone District the following described land: Beginning at the point which is 262.3 feet East of the Northwest corner of the SW'-4 SW', S10'4 of said Section 15, said point being the Northeast corner of the parcel of land described in Book 1765 at Page 255, Jef- ferson County Records; thence South along the East line of said parcel described in Book 1765 at Page 255 and parallel with the West line of said Section 15, a distance of 100 feet. to the Southeast corner of said parcel; thence West along the South line of said parcel, a distance of 75 feet, more or less, to the Easterly line of a parcel of land conveyed to Phillips Petroleum Company, a Delaware corporation, in Book 1766 at Page 308 and 311; thence North 0022' West along said Easterly line and a Northerly extension of said Easterly line to the North line of the SW'4 SW.z SW'a of said Section 15; thence Easterly along said North line a distance of 75 feet more or less to the Point of Beginning, except the North 25 feet thereof, County of Jefferson, State of Colorado. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge; that it is promulgated for the health, safety, and welfare of the pub- lic, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remained of this ordinance or its application to other persons or circumstances. Section 4. This ordinance shall take effect 1 day after final publication. INTRODUCED, READ, AND ADOPTED on first reading by a vote of 6 to 0 on this 29th day of October , 1979; ordered published in full in a newspaper of general circulation in the City of Wheat Ridge, and Public Hearing and consideration on final passage set for December 10 , 1979, at 7:30 o'clock P.M., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado READ, ADOPTED, AND ORDERED PUBLISHED on second and final reading by a vote of 8 to 0 , this 10th day of December , 1979.
