TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A CORRECTION OF A LEGAL DESCRIPTION
FOR CASE WZ-76-22 AND FOR A CORRECTION OF THE. ZONING MAP FROM RESTRICTED
COMMERCIAL (R-C) AND COMMERCIAL ONE (C-1) TO COMMERCIAL ONE (C-1) ON PROPERTY
WHICH IS INVOLVED IN ZONING DISCREPANCY CASE WZ-78-SSD LOCATED AT 9684 AND
9690 WEST 44TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by the City of Wheat Ridge for approval of a correction
of a legal description for Case WZ-76-22 and for a correction of the zoning map from
Restricted Commercial (R-C) and Commercial One (C-1) to Commercial One (C-1) in Zoning
Discrepancy Case No. WZ-78-55D and pursuant to findings made based upon testimony and
evidence presented at public hearing before the Wheat Ridge City Council the legal
description in Case IVZ-76-22 is hereby corrected as per the legal description below,
and Wheat Ridge Zoning Maps are hereby amended to exclude from Commercial One (C-1)
and Restricted Commercial (R-C) zone districts and to include in the Commercial One
(C-1) zone district the following described land:
The East 72.5 feet of that part of the Southwest % of the
Section 22, T3S, R69W described as follows: Beginning at
of the East line of the Southwest of the Northwest 14 of
and the south line of the North Golden Road; thence South
West 147.5 feet; thence North 147.5 feet, thence East to
Jefferson County, Colorado; and

The West 75 feet of that part of the Southwest 4 of the Northwest 4 of
Section 22, T3S, R69W described as follows: Beginning at the intersection of
the East line of the Southwest 1-4 of the Northwest '4 of said Section 22 and
the South line of the North Golden Road; thence South 147.5 feet; thence
West 147.5 feet; thence North 147.5 feet; thence East to the point of
beginning, Jefferson County, Colorado.
Section 2. Safety Clause. The City Council hereby finds, determines, and declares
that this ordinance is promulgated under the general police power of the City of
Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the preservation of health and safety and for
the protection of public convenience and welfare. The City Council further determines
that the ordinance bears a rational relation to the proper legislative object sought
to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for any
reason be adjudged by a court of competent jurisdiction invalid, such judgment shall
not affect, impair or invalidate the remainder of this ordinance or its application
to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on
this 9th day of June , 1980; ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing and
consideration on final passage set for July 14 , 1980, at 7.30
o'clock p.m., in the Council Chambers, 7500 [Vest 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of
8 to 0 , this 14th day of July 1980.
