SERIES OF 1980
TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
COMMERCIAL ONE (C-1), RESTRICTED COMMERCIAL (R-C) AND
RESIDENTIAL TWO (R-2) TO PLANNED COMMERCIAL DEVELOPMENT (PCD)
FOR LAND LOCATED AT APPROXIMATELY 4940 WARD ROAD, CITY OF WHEAT
RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO,
THAT:
Section 1. Upon application of B. A. Wyatt for approval of rezoning in
Wheat Ridge, Colorado, Case No. WZ-80-3 and based upon recommendation for
approval from the Wheat Ridge Planning Commission and pursuant to findings
made based on testimony and evidence presented at public hearing before
the Wheat Ridge City Council, Wheat Ridge maps are hereby amended to
exclude from the Commercial One, Restricted Commercial and Residential
Two Districts and to include in the Planned Commercial Development District
and approve a Preliminary Development Plan the following described land:
Commencing at the south one-quarter corner of said section 17; thence
north 0°16'00" east along the north/south centerline of said section
17, a distance of 936.52 feet; thence north 89°41'00" east, a distance
of 30.00 feet, to the westerly line of said Plot 3, said point being
the true point of beginning; thence continuing north 89°41'00" east,
a distance of 168.49 feet, to the westerly line of a parcel of land
described in Book 2091, page 392, Jefferson County Records; thence
south 0°16'00" west and along the westerly line of a parcel of land
described in Book 2091, page 392, Jefferson County Records, a distance
of 98.73 feet; thence north 39°41'00" east and along the southerly
line of a parcel of land described in Book 2091, page 392, Jefferson
County Records, a distance of 155.00 feet, to the Southeast corner
of a parcel of land described in Book 2091, page 392, Jefferson
County Records; thence south 0°16'00" west and along the westerly
line of a parcel of land described in Book 1.580, page 388, Jefferson
County Records, a distance of 133.00 feet, to the southerly line of
said Plot 3; thence south 89°41'00" west and along the southerly line
of said Plot 3, a distance of 323.49 feet, to the Southwest corner
of said Plot 3; thence north 0°16'00" east and along the westerly
line of said Plot 3, a distance of 231.73 feet, to the true point of
beginning. Containing 59,656.10 square feet or 1.37 acres more or
less.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this ordinance
is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council further
determines that the ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.

INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to
0 on this 215t day of July , 1980; ordered published in
full in a newspaper of general circulation in the City of Wheat Ridge
and Public Hearing and consideration on final passage set for
August 11 (Continued to 8/25) , 1980, at 7:30 o'clock p.m., in the
Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
vote of 8 to 0 , this 25th day of August 1980.
