ORDINANCE NO. 424
SERIES OF 1980
TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM RF,SIDENTIAL
TWO (R-2) AND RESTRICTED COMMERCIAL (R-C) TO PLANNED COMMERCIAL
DEVELOPMENT (PCD) AND APPROVAL OF A PRELIMINARY DEVELOPMENT PLAN ON
LAND LOCATED AT APPROXIMATELY THE SOUTHEAST CORNER OF 50TH AVENUE AND
INDEPENDENCE STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE
OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT.
Section 1. Upon application of Warren Cruise for approval of rezoning and a
Preliminary Development Plan in Wheat Ridge, Colorado, Case No W_-80-11 and
based upon recommendation for approval from the Wheat Ridge Planning Commission
and pursuant to findings made based on testimony and evidence presented at public
hearing before the Wheat Ridge City Council, Wheat Ridge maps are hereby amended
to exclude from the Residential Two and Restricted Commercial and to include in
the Planned Commercial Development District, and a Preliminary Development Plan is
approved on the following described land:
A part of the Southwest one-quarter of Section 15, Township 3 South, Range 69
West, of the 6th P.M., City of Wheat. Ridge, Countv of Jefferson, State of
Colorado, more particularly described as follows: Commencing at the Southeast
corner of the Northeast one-quarter of the Southwest one-quarter of said
Section 15; thence South 89°53'36" West alon. the South line of said Northeast
one-quarter 660.85 feet to the point of beginning, said point being boundary
corner number 2 of Garrison Place Filing No. 1 as recorded in Jefferson County,
Colorado; thence South 0°00'59" East along the boundary of said Garrison Place
Filing No. 1 a distance of 479.12 feet; thence South 89°53'39" West along said
boundary 630.49 feet to a point on the easterly right of way line of Independence
Street; thence North 0°03'29" West along said easterly right of way line 545.10
feet to a point of curve; thence along a curve to the left having a radius of
280.00 feet, a central angle of 26°45'56" and an arc length of 130.80 feet;
thence on an angle to the right of 26°45'56" and North 0°03'29" West 92.25
feet to a point on the southerly right of way line of a 100 foot wide Public
Service Company right of way; thence North 74°09'00" East along said southerly
right of way line 244.03 feet to a point of curve; thence along said southerly
right of way line and along a curve to the right having a radius of 5686.83
feet, a central angle of 4°25'21" and an arc length of 438.95 feet to boundary
corner number 19 of said Garrison Place Filing No. l; thence South 0°00'30"
East along the boundary of said Garrison Place Filing No. 1 a distance of
134.27 feet; thence South 0°01'20" West 319.00 feet to the point of beginning,
containing 12.506 acres more or less.
Section 2. Safety Clause. The City Council hereby finds, determines, and declares
that this ordinance is promulgated under the general police power of the City of
Wheat Ridge, that it is promulgated for the health, safety, and welfare of the
public, and that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, naragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for any
reason be adjudged by a court of competent jurisdiction invalid, such judgment
shall not affect, impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to _0 _on this
22nd day of September , 1980, ordered published in full in a newspaper of
general circulation in the City of Wheat Ridge and Public Hearing and consideration
on final passage set for October 20 , 1980, at 7:30 o'clock p.m., in the
Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
