MODEL TRAFFIC CODE-- ADOPTEDI OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE BY INCORPORATING THEREIN ALL AMENDMENTS ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF COLORADO IN HOUSE BILL 1242 AND HOUSE BILL 1034 RELATING TO THE REGULATIONS OF THE LENGTH OF MOTOR VEHICLES WHEN OPERATED ON THE HIGHWAYS AND THE LIMITATIONS ON THE SIZE AND WEIGHT OF VEHICLES OPERATING ON ROADS AND HIGHWAYS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO: WHEREAS, the City of Wheat Ridge, by and through its City Council, has previously adopted by reference the "Model Traffic Code for Colorado Municipalities," 1977 Edition, which has been codified in Section 12-1, et secs. of the Code of Laws of the City of Wheat Midge; WHEREAS, the General Assembly of the State of Colorado in 1979 enacted House Bill 1242 and House Bill 1034 relating to the length of motor vehicles and limiting the size and weight of vehicles; WHEREAS, the City of Wheat Ridge, acting through its City Council, wishes expressly to adopt said amendments as a portion of the Model Traffic Code enacted by, and in force and effect within the corporate limits of, the City of Wheat Ridge, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Wheat Ridge, Colorado: Section 1. The Model Traffic Code as enacted and in force within the City of Wheat Ridge is hereby amended by the following amendments: Subsection 18-3(d) is amended to read as follows: (d) No combination of vehicles coupled together shall consist of more than 4 units, and no such combina- tion of vehicles shall exceed a total overall length of 70 feet. Said length limitations shall not apply to vehicles operated by a public utility when required for emergency repair of public service facilities or properties, or when operated under special permit as provided in section 18-11 of this Code, but in respect to night transportation every such vehicle and the load thereon shall be equipped with a sufficient number of clearance lamps on both sides and marker lamps upon the extreme ends of any projecting load to clearly mark the dimensions of such load. The limitations provided in this section shall be strictly construed and enforced. #435 PAGE TWO Subsection 18-7(b)(2) is amended to read as follows: (2) When the wheels attached to said axle are equipped with low-pressure pneumatic tires, 20,000 pounds. Subsection 18-8(a)(1) is amended to read as follows: 18-8(a)(1)(i) The gross weight upon any one axle of a vehicle shall not exceed the limits prescribed in section 18-7. (ii) Subject to the limitations prescribed in section 18-7, the gross weight of a vehicle having two axles shall not exceed thirty-six thousand pounds. (iii) Subject to the limitations prescribed in section 18-7, the gross weight of a single vehicle having three or more axles shall not exceed fifty-four thousand pounds. Subsection 18-8(b) is amended to read as follows: 18-8(b) Notwithstanding any other provisions of this section, except as may be authorized under section 18-11 of this Code, no vehicle or combination of vehicles shall be moved or operated on any highway or bridge which is part of the national system of inter- state and defense highways, also known as the "Interstate System," when the gross weight of such vehicle or combination of vehicles exceeds the follow- ing specified limits. (1) Subject to the limitations prescribed in section 18-7 of this Code, the gross weight of a vehicle having two axles shall not exceed thirty-six thousand pounds. (2) Subject to the limitations prescribed in section 18-7 of this Code, the gross weight of a single vehicle having three or more axles shall not exceed fifty-four thousand pounds. (3) Subject to the limitations prescribed in section 18-7 of this Code, the maximum gross weight of any vehicle or combination of vehicles shall not exceed that determined by the formula W equals 500 (LN divided by N-1 + 12N + 36); W equals overall gross weight on any group of two or more consecutive axles to the nearest 500 pounds, L equals distance in feet between first and last axles of such vehicle or combination of vehicles, and N equals number of axles; but in computations of this formula no gross vehicle weight shall exceed eighty thousand pounds, except as may be authorized under section 18-11 of this Code. (4) For the purposes of this section, where a com- bination of vehicles is used, no vehicle shall carry a gross weight of less than ten percent of the overall gross weight of the combination of vehicles; except that this limitation shall not apply to spe- cialized trailers whose specific use is to haul poles and whose axles may carry less than ten percent of the weight of the combination. #435 PAGE THREE Section 2. Any provision of the Model Traffic Code or any other ordinance of the City of Wheat Ridge in conflict with any of the provisions contained herein is hereby expressly repealed. Section 3. Safety Clause. The City Council hereby finds, determines and declares that this ordinance is promulgated under the police power of the City of Wheat Ridge; that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to these objectives. Section 4. Severability. If any clause, sentence, para- graph or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect 1 day after final publication.
