TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
AGRICULTURAL-TWO (A-2) AND INDUSTRIAL (I) TO INDUSTRIAL
(I), AND APPROVAL OF A PRELIMINARY DEVELOPMENT PLAN ON LAND
LOCATED AT APPROXIMATED 12200 W. 52nd AVENUE, CITY OF WHEAT
RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT'
Section 1. Uron a-Dtilica_i.on o' P_laLc:iley Associates for approval of
rezoning and a Prelir.,d nary Development Plan in Wheat Ridge, Colorado,
Case No. WZ-30-29 and based upon recommendation for approval from the
Wheat Ridge Planning Commission and pursuant to findings made
based on testimony and evidence esented at public hearing before
the Wheat Ridge Cite Council, Wheat Ridge maps are hereby amended to
exclude from the Agricultural-Two and Industrial Zone Districts and
to include in the Industrial Zone District, and approve a Preliminary
Development Plan on the following described land:
Beginning at the center of said Section 17; thence N900 00'00"E
on an assumed bearing along the East-[lest centerline of said
Section 17 a distance of 536.71 feet; thence SO 25'00"w a
distance of 27.97 feet to the Northwest corner of the East 1/2
of Lot 13. STANDLEY HEIGHTS, as constructed, being the TRUE
POINT OF BEGINNING; thence N80°47'00"E along the North lire
of said Lot 13 a distance of 280.73 feet to a point, said point
being 26.91 feet Southerly of the East-West centerline of said
Section 17; thence SO°25'00"W a distance of 150.00 feet; thence
N89047'00':E a distance of 240.00 feet to the East line of
said Lot 13 as constructed; thence SO°25'00"W along the as-
constructed East line of said Lot 13 a distance of 265.06 feet;
thence S890 47'00"W parallel with the as-constructed North line
of said Lot 13 a distance of 520.73 feet to the Southwest corner
of the East 1/2 of said Lot 13 as constructed, said point being
537.29 feet Easterlv of the North-South centerline of Said
Section 17; thence NO°25'00"E a distance of 415.06 feet to
the TRUE POINT OF BEGINNING, County of Jefferson, State of
Colorado.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police rower of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this ordinance
is necessary for the -Dreservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to
the oroper legislative object sought to be attained.
Section 3. Severability. If anv clause, sentence, paragraph, or
hart of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to
other persons or circumstances.
Section 4. This ordinance shall take effect _ 1 day after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to
0 on this 15th day of December , 1980; ordered
published in full in a newspaper of general circulation in the City

of wheat Ridge and Public Hearing and consideration on final passage
set for January 19 1981, at 7:30 o'clock p.m., in the
Council Chambers, 7500 Nest 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
