COLORADO, THAT:
section 1. Upon application of Alvin L. and Dennis L. rioefer for
approval of rezoning in Wheat Ridge, Colorado, Case do. ,9Z-80-25
and based upon recommendation for approval from the 4heat Ri3ge
Planning Commission and pursuant to findings made based on
testimony and evidence presented at public hearing before the
wheat Ridge City Council, ,dheat Ridge maps are hereby amended to
exclude from the Restrictea Commercial District and to include in
the Commercial One District the following described land:
'she North 170 feet of the East 1/2 of the t-vest 2/5 of
the -[dorm 1/3 of !ilocK 12, Lee's SuI Division, Except
the Horth 10 feet thereof.
Section 2. Satety_Clause. the City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of ^Zheat Ridge, that it is
promulgated for the nealth, safety, and welfare of the public,
arid that this ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
ana welfare. Tne City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.
:,ection 3. S_everabi_lity. If any clause, sentence, paragraph, or
part of tlris ordinance or the application thereof to any person
or circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the -remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect _15_ days after
final publication.
INTRODUCED, READ, AND ADUPTED on first reading by a vote of 7
to 0 on this 12th day of January 1S3i; ordered ?published
in full in a newspaper of general circulation in the City of
vVheat Ridge and Public hearing and consideration on final passage
set for February ° 1981, at 7:30 o'clock p.m., in the
Council Chambers, 7500 :-Vest 29th Avenue, `1heat Rid<ae, Colorado.
READ, ADOP'i'r0 AJD ORDERED PUBLISHED on second and final reading
by a vote of 7 to 1 this _9th day of February 1981.
