TITLE: AN ORDINANCE PROVIDINC FOR THE APPROVAL OF REZONING FROM
RESIDENTIAL-THREE (R-3), RESTRICTED COMMERCIAL-ONE (RC-1),
AND COMMERCIAL-ONE (C-1) TO COMMERCIAL-ONE (C-1) WITH A
CONDITIONAL SITE PLAN ON LAND LOCATED AT APPROXIMATELY
THE NW CORNER OF WEST 38TH AVENUE AND SHERIDAN BOULEVARD,
CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application of Marquette Properties for approval
of a rezoning in Wheat Ridge, Colorado, Case No. WZ-81-7 and based
upon recommendation for approval from the Wheat Ridge Planning
Commission and pursuant to findings made based on testimony and
evidence presented at public hearing before the Wheat Ridge City
Council, Wheat Ridge maps are hereby amended to exclude from the
Commercial-One, Fesidential_-Three, and Restricted Commercial-One
Districts and to include the Commercial-One District, and approve
a site plan on the following, described land:
A parcel of land located within the Southeast 1/4 of Section
2,, Township 3 South, Range 69 West of the 6th Principal
Meridian, City of Wheat Ridge, County of Jefferson, State
of Colorado, being more particularly described as follows:
Commencing at a point 30.00 feet Northerly and 141.00 feet
Westerly of the Southeast corner of said Section 24, said
point being recorded in Book 1992 at Page 365, said point
also falling on the Northerly right-of-way of West 38th Avenue;
thence N00100'30"E a distance of 135.00 feet; thence S89044'00"E
a distance of 111.00 feet to a point on the Westerly right-of-
way line of Sheridan Boulevard; thence No0°00'30"E along the
said Westerly right-of-way line a distance of 269.00 feet;
thence S89044100"E a distance of 30.00 feet to the centerline
of Sheridan Boulevard, said centerline also being the East
line of said Section 24; thence N00100'30"E along said East
line of Section 24, a distance of 94.00 feet; thence N89044'00"W
a distance of 150.00 feet; thence N00100'30"E a distance of
54.00 feet; thence N89°44'00"W a distance of 180.94 feet;
thence N00000130"E a distance of 55.40 feet to a Point on the
Southerly right-of-wav line of West 40th Avenue, thence
N39°44'00"W along the said Southerly right-of-way line a
distance of 30.67 feet; thence S00°00'30"W a distance of 137.40
feet, thence N89044'00"W a distance of 200.57 feet; thence
Soo°00'30"W a distance of 40.65 feet; thence N89144'00"W a
distance of 100.00 feet; thence S00100'30"W a distance of
429.35 feet to a point on the Northerly right-of-way line of
West 38th Avenue; thence S89044'00"E along the said Northerly
right-of-way line a distance of 331.24 feet; thence SOO°00'30"W
a distance of 30.00 feet to a point on the South line of said
Section 24; thence S89044'00"E along the said South line of
Section 24 a distance of 125.94 feet; thence N00°00'30"E a
distance of 30.00 feet to a point on the Northerly right-of-wav
line of West 38th Avenue; thence S89°44'00"E along said Northerly
right-of-way line a distance of 64.00 feet to the point of
beginning. The above described tract of land contains
307,081 square feet (7.0496 acres), more or less.
Section 2. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is ,)romulgated for
the health, safety, and welfare of the public, and that this ordinance

is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to
the proper legislative object sought to he attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to
other persons or circumstances.
Section 4. This ordinance shall take effect 5 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to

full in a newspaper of general circulation in the City of Wheat Ridge
and Public Hearing and consideration on final passage set for
May 18 , 1981, at 7:30 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
