HomeMy WebLinkAboutOrdinance-1982-0489INTRODUCED BY COUNCILMEMBER AIELLO ORDINANCE NO. 489 Series of 1982 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A SPECIAL USE PERMIT WITH CONDITIONS IN A COMMERCIAL-ONE (C-1) ZONE ON LAND LOCATED AT 4785 KIPLING STREET, WHEAT RIDGE, COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application of Kenneth Frens for approval of a Special Use Permit in Wheat Ridge, Colorado, Case No. SUP-81-10 and based on recommendation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council, a Special Use Permit for the operation of a garage for repair of motor vehicles is hereby approved with conditions for the following described land: That part of the East one-half of the East one-half of the Northeast one-quarter of Section 21, Township 3 South, Range 69 West of the 6th P.M., more particularly described as follows: Beginning 134 feet North of the Southeast corner of the North 7-1/2 acres of the East one-half of the East one-half of the Northeast one-quarter of said Section 21; thence North 67 feet along the East line; thence 221 feet West, parallel with the South line; thence 67 feet South, parallel with the East line; thence East 221 feet to the point of beginning; Except the East 30 feet conveyed to Jefferson County by instrument recorded in Book 1555, Page 127, Jefferson County Records; Except tract of land conveyed to the Department of Highways, State of Colorado by instrument recorded in Book 1920 at Page 429, Jefferson County Records, County of Jefferson, State of Colorado. Section 2. Conditions. The permitted uses of this Special Use Permit within the Commercial-One C-1) zone district for the parcel described above shall be as follows: 1. Garages for the repair of motor vehicles entirely within an enclosed building. 2. Said permit will be in effect until the property is transferred or sold. 3. An opaque, 6 foot fence shall be constructed along the north and south property lines to screen any vision of stored vehicles. Section 3. Safety Clause. The City Council hereby finds, determines and declares that this ordinance is promulgated under the police power of the City of Wheat Ridge; that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to these objectives. Section 4. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 5. This ordinance shall take effect 15 days after final publication.
