TITLE: AN ORDINANCE INITIATING AN AMENDMENT TO THE HOME RULE
1 CHARTER OF THE CITY OF WHEAT RIDGE, AMENDING SECTION
4.5 (b).

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Section 4.5 (b) of the Wheat Ridge Home Rule Charter
shall be amended by repealing and reenacting the second sentence
of said Section 4.5(b) as follows:

"He shall serve the unexpired term until the following
General Municipal Election and his successur is duly
;i qualified."
Section 2. The ballot title shall read as follows:
"Shall Section 4.5(b) of the Wheat Ridge Home Rule Charter
be amended so as to provide that the length of service of
Councilmember appointment to fill a vacancy shall be until
the next General Municipal Election?"

Section 3. This Charter Amendment ordinance shall be submitted
to a vote of the Registered Electors at the July 12, 1983 Special
Municipal Election, and if adopted, shall take effect immedi-
ately.
Section 4. Safety Clause. The City Council hereby finds,
determines and declares that this Ordinance is promulgated under
the police power of the City of Wheat Ridge; that it is promul-
gated for the health, safety, and welfare of the public; and that
this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.

The City Council further determines that the ordinance bears a
rational relation to these objectives.
Section 5. Severability. If any clause, sentence, paragraph,
or part of this ordinance or the application thereof to any per-
_Aon or circumstances shall for any reason be adjudged by a court

~f competent jurisdiction invalid, such judgment shall not af-
•fect, impair or invalidate the remainder of this ordinance or its
