TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM COMMERCIAL-ONE
ONE (C-1) TO PLANNED COMMERCIAL DEVELOPMENT (PCD) AND FOR APPROVAL OF A
COMBINED OUTLINE AND FINAL DEVELOPMENT PLAN AND PLAT ON LAND LOCATED AT
12351 WEST 44TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE
OF COLORADO
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by Public Storage, Inc., for approval of rezoning
in Wheat Ridge, Colorado, Case No. WZ-83-16, and based upon recommendation for
approval from the Wheat Ridge Planning Commission and hearing before the Wheat
Ridge City Council, Wheat Ridge maps are hereby amended to exclude from the
Commercial-One and to include in the Planned Commercial District and does
hereby approve a combined outline and Final Development Plan and Plat, on the
following described land:
Certain tract of land located in the NE 1/4 of Section
20, T3S, R69W of the 6th P.M., is a part of lot 16 of Nicholas
Gardens Subdivision, and is more particularly described as follows:
Beginning at the N 1/4 corner of said section 20, T3S, R69W; thence
south 00 degrees 00'15" East, a distance of 1571.58 feet; thence
north 89 degrees 59'45" East, a distance of 60.0 feet to a point,
said point being the intersection of a line 60.0 feet east of and
parallel with the centerline of Ward Road, and a line 150.0 feet
southerly of and parallel with the centerline of Interstate
Highway No. 70, and also the true point of beginning; thence along
said Interstate Highway No. 70 right-of-way as follows:North 64
degrees 20'30" East, a distance of 184.6 feet; thence south 89
degrees 05'30" East, a distance of 111.8 feet; thence south 43
degrees 20'30" East, a distance of 164.6 feet; thence south 00
degrees 00'15" East, a distance of 127.4 feet; thence leaving said
right-of-way, north 89 degrees 40' West, a distance of 100.0 feet;
thence south 00 degrees 00'15" East, a distance of 140.0 feet to a
point on the north right-of-way line of West 44th Avenue; thence
along said right-of-way line north 89 degrees 40' West a distance
of 91.2 feet; thence north 00 degrees 00'15" West, a distance of
150.0 feet; thence north 89 degrees 40' West, a distance of 200.0
feet to a point on the east right-of-way of Ward Road; thence north
00 degrees 00'15" West along said east right-of-way line of Ward
Road, a distance of 156.7 feet to the true point of beginning,
County of Jefferson, State of Colorado, above description contains
93,958.920 square feet more or less.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this ordinance
or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to 0 on
this 25th day of July , 1983, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for August 22 , 1983, at 7:30
o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge,
Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of
to 2 , this 22nd day of August 1983.
