TITLE: AN ORDINANCE AMENDING SECTION 2-17 OF THE CODE OF LAWS OF
THE CITY OF WHEAT RIDGE BY REDUCING THE MEMBERSHIP OF THE
CIVIL SERVICE COMMISSION FROM EIGHT (8) MEMBERS TO FIVE
(5) MEMBERS AND PROVIDING FOR THE APPOIidTMENT OF ONE
MEMBER FROM THE CITY AT LARGE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. Section 2-17(b) of the Code of Laws of the City of
Wheat Ridge is hereby repealed and reenacted as follows:
"(b) All boards and commissions, except the board of
adjustment,( AND THE CIVIL SERVICE COMMISSION, shall consist
of eight (8) regular members, to be appointed by a majority
vote of the members of the city council. Regular members
of all boards and commissions shall have equal voting strength
on their respective board or commission, and shall be autho-
rized to attend, participate in, and vote at their respec-
tive board or commission meetings. The attendance of
five (5) regular members shall constitute a quorum for
the transaction of business at each meeting of such boards
or commissions, and the affirmative vote of a simple
majority shall be required to adopt any motion or make or
ratify any decision of the board or commission.
Members of boards and commissions shall serve terms of
three (3) years, and such members may be reappointed to
serve additional three-year terms of office. All appoint-
ments to all boards and commissions shall be made to
achieve equal representation from each council district
to each board or commission. All members of boards or
commissions presently serving shall be entitled to complete
the term for which they were appointed, and shall be subject
to reappointment at the discretion of city council."
Section 2. Section 2-17 of the Code of Laws of the City of Wheat
Ridge is hereby amended by the addition of a new subsection 2-17(d)
as follows:
"(D) THE CIVIL SERVICE COMMISSION SHALL BE COMPRISED OF
FIVE (5) REGULAR MEMBERS. NOTWITHSTANDING ANY OTHER PRO-
VISION OF THIS SECTION 2-17, A QUORUM FOR THE TRANSACTION
OF BUSINESS BY THE CIVIL SERVICE COMMISSION SHALL BE THREE
(3) MEMBERS. MEMBERSHIP ON THE CIVIL SERVICE CODIMISSIO14
SHALL BE COMPRISED OF ONE (1) REGULAR MEMBER FROM EACH
COUNCIL DISTRICT, TO BE APPOINTED BY A MAJORITY VOTE OF
THE MEMBERS OF THE CITY COUNCIL, AND ONE (1) MEMBER APPOINTED
AT LARGE WITHOUT REGARD TO COUNCIL DISTRICT WHO SHALL BE
APPOINTED BY THE MAYOR SUBJECT TO CONFIRMATION BY THE
MAJORITY VOTE OF THE MEMBERS OF THE CITY COUNCIL. THE
REMAINING PROVISIONS OF SECTION 2-17 OF THIS CODE OF LAWS
SHALL BE APPLICABLE TO MEMBERS OF THE CIVIL SERVICE
COMMISSION."
Section 3. The Code of Laws of the City of Wheat Ridge is amended
by renumbering present sections 2-17(d) and 2-17(e) to 2-17(e)
and 2-17(f) respectively.
Section 4. Safety Clause. The City Council hereby finds, deter-
mines, and declares that this ordinance is promulgated under the
police power of the City of Wheat Ridge; that it is promulgated
for the health, safety, and welfare of the public; and that this
ordinance is necessary for the preservation of health and safety
for the protection of public convenience and welfare. The City
Council further determines that the ordinance bears a rational
relation to these objectives.

Section 5. Severability. If any clause, sentence, paragraph,
or part of this ordinance or the application thereof to any person
or circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair, or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 6. This ordinance shall take effect 15 day(s) after
final publication.
INTRODUCED READ, AND ADOPTED on first reading by a vote of 7
to 1 this 10th day of October 1983; ordered published
in full in a newspaper of general circulation in the City of
Wheat Ridge and Public Hearing and consideration on final passage
set for November 14 , 1983, at 7:30 p.m., at Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED, AND ORDERED PUBLISHED on second and final reading
by a vote of 5 to 3 this 14th day of November , 1983.
