HomeMy WebLinkAboutOrdinance-1983-0560INTRODUCED BY COUNCILMEMBER KELLER ORDINANCE N0. 560 Series of 1983 TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF AN AMENDED OUTLINE DEVELOPMENT PLAN, INCLUDING REVISIONS TO PERMITTED USES, FOR A PLANNED INDUSTRIAL DEVELOPMENT (PID) KNOWN AS POWDERHORN PARK AND APPROVAL OF A FINAL DEVELOPMENT PLAN ON LAND LOCATED AT 4890 VAN CORDON STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT: Section 1. Upon application by Cletus and Carol Donahue for approval of an amended Outline Development Plan, including revisions to permitted uses, for a Planned Industrial Development (PID) known as Powderhorn Park and approval of a Final Development Plan in Wheat Ridge, Colorado, Case No. WZ-83-26 and based upon recommendation for approval from the Wheat Ridge Planning Commission and pursuant to findings made based on testimony and evidence presented at public hearing before the Wheat Ridge City Council. The following described land, the Amended Powderhorn Park - Planned Industrial Development Plan (combined Outline and Final) is hereby approved. Said plan applies to a parcel of land legally described as follows: All of lot 1, Block 1 of Powderhorn Park Subdivision being a portion of the SW 1/4 of the SE 1/4 of Section 17, T3S, R69W of the 6th P.M., Jefferson County, Colorado, more particularly described as follows: Beginning at the northeasterly corner of said Powderhorn Park Subdivision; thence SUU°29'59"W a distance of 25.00 feet to the northeasterly corner of said Lot 1, Block 1, said northeasterly corner also being the TRUE POINT OF BEGINNING; thence along the easterly, southerly, westerly and northerly boundaries of said Lot 1, Block 1 by the following six (6) courses: 1) S00°29'59"W a distance of 259.80 feet; thence 2) N89°59'04"W a distance of 623.00 feet; thence 3) N00°30'23" a distance of 188.49 feet; thence 4) M73030'57"E a distance of 225.69 feet to the beginning of a tangent curve to the right having a radius of 175.00; thence 5) Northeasterly along the arc of said curve a distance of 50.40 feet, through a central angle of 16°29'59", to a point of tangent; thence 6) S89°59'04"E a distance of 357.49 feet to the TRUE POINT OF BEGINNING, containing 3.518 acres (153,244 square feet), more or less. Section 2. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair or invalidate the remainder of this ordinance or its application to other persons or circumstances.
