HomeMy WebLinkAboutOrdinance-1984-0591INTRODUCED BY COUNCILMEMBER KP11Pr EMERGENCY ORDINANCE NO. 591 Series of 1984 TITLE: AN EMERGENCY ORDINANCE SUSPENDING THE PROVISIONS OF SECTION 18(A)13(b) OF APPENDIX A OF THE CODE OF LA117S OF THE CITY OF WHEAT RIDGE, AND IMPOSING A MORATORIUM UPON THE ESTABLISHMENT OF NEW AND USED CAR SALES LOTS WITHIN THE CITY OF WHEAT RIDGE BASED UPO?`I THE EMERGENCY FOUND BY THE CITY COUNCIL AND SPECIFIED HEREIN. WHEREAS, an emergency exists in the proliferation of new and used car sales lots within the City of Wheat Ridge; WHEREAS, the City Council of the City of Wheat Ridge finds that, unless a moratorium upon the creation of additional new and used car sales lots is imposed immediately, additional new and used car sales facilities will be established or expanded within the City of Wheat Ridge which will damage or destroy the quality of existing neighborhoods within the City of Wheat Ridge; WHEREAS, a comprehensive ordinance regulating the establishment and expansion of said new and used car sales lots is being prepared and considered by the Wheat Ridge Planning Commission and City Council, and it is in the best interest of the citizens of the City of Wheat Ridge to preclude additional new or used car sales lots within the City of Wheat Ridge until such time as said comprehensive ordinance is adopted; WHEREAS, an emergency as defined in Section 5.13 of the Home Rule Charter of the City of Wheat Ridge exists in that imposition of the suspension and moratorium is necessary for the immediate preservation of public and private property; NOW1 THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE: Section 1. The provisions of Section 18(A)13(b) of Appendix A of the Code of Laws of the City of Wheat Ridge are hereby suspended and a moratorium is hereby imposed, for the time periods specified in Section 4 hereof, and during said time period no additional uses authorized by said Section 18(A)13(b) shall be initiated or expanded except as provided herein. Section 2. The City Council specifically finds that an emergency exists as defined in Section 5.13 of the Home Rule Charter of the City of Wheat Ridge and failure to act as specified herein would result in damage to public and private properties within the City. Section 3. If any clause, sentence, paragraph, or part of this Ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair, or invalidate the remainder of this Ordinance or its application to other persons or circumstances. Section 7. Safety Clause. The City Council of the City of Wheat Ridge hereby finds, determines, and declares that this is an Emergency Ordinance, promulgated pursuant to Section 5.13 of the Home Rule Charter of the City of Wheat Ridge and is necessary for the immediate preservation of the public property, health, peace, safety, and welfare. The City Council further determines that this Ordinance bears a rational relation to the proper legislative object sought to be attained. This Ordinance was adopted by a vote of 8 to 0 on October 22, 1984, and, pursuant to Section 5.13 of the Home Rule Charter of the City of Wheat Ridge, became effective at said date and time.
