TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM
RESIDENTIAL-THREE AND COMMERCIAL-ONE TO COMMERCIAL-ONE ON LAND LOCATED
AT THE SOUTHEAST COR14ER OF WEST 44TH AVENUE AND YARROW STREET, CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED 13Y THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by City of Wheat Ridge for approval of rezoning
in Wheat Ridge, Colorado, Case No. WZD-84-32 and based upon recommendation for
approval from the Wheat Ridge Planning Commission, and pursuant to findings
made based on testimony and evidence presented at public hearing before the
Wheat Ridge City Council, Wheat Ridge maps are hereby amended to exclude from
the Residential-Three and Commercial-One Districts and to include in the
Commercial-One District, the following described land:
A parcel of land located in the Southwest Quarter (SW 1/4) Section 23,
Township 3 South, Range 69 West of the Sixth Principal Meridian all
being located in the City of Wheat Ridge, County of Jefferson, State
of Colorado and being more particularly described as follows:
Beginning at the True Center of Section 23, Township 3 South, Range 69
West according to the 1973 Colorado Revised Statute 38-50-101, thence
South 89055'27" West along the North line of the Southwest Quarter (SW
1/4) Section 23, Township 3 South, Range 69 West a distance of 359.700
feet to the Northwest Corner of a parcel of land recorded in Book 529,
Page 267 of the Jefferson County Records, said point being the TRUE
POINT OF BEGINNING; thence continuing South 89055'27" West along the
North line of the Southwest Quarter (SW 1/4) Section 23, Township 3
South, Range 69 West a distance of 299.556 feet to the Northwest
Corner, Northeast Quarter (NE 1/4), Northeast Quarter (NE 1/4),
Southwest Quarter (SW 1/4) Section 23, Township 3 South, Range 69
West; thence South 00006122" East along the West line of the Northeast
Quarter (NE 1/4), Northeast Quarter (NE 1/4), Southwest Quarter (SW
1/11) Section 231 Township 3 South, Range 69 West a distance of 315.000
feet to the Southwest Corner of Commmercial-One (C-1) zoning
correction; thence North 89055'27 East and parallel with the North
line of the Southwest Quarter (SW 1/4) Section 23, Township 3 South,
Range 69 West said line being the South line of the Corrimercial-One
(C-1) zoning correction and the North line of the Residential-Three
(R-3) zoning correction a distance of 299.390 feet to a point on the
East line of a parcel of land recorded in Book 1786, Pages 516 to 520
inclusive of the Jefferson County Records; thence North 00004'33" West
along the East line of a parcel of land recorded in Book 1786, Pages
516 to 520 inclusive and the West line of a parcel of land recorded in
Book 529, Page 267 of the Jefferson County Records a distance of
315.000 feet to the TRUE POINT OF BEGINNING. The above described
parcel of land contains 94,333.990 square feet or 2.16561 acres, more
or less.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
publication.

INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to __(L__on
this 14th day of January, 1985, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for February 11 , 1985, at 7:30
o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge,
Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of
7 to 0 , this 11th day of Februa_~ , 1985.
