TITLE: AN ORDINANCE PROVIDING FOR AN AMENDMENT TO THE OUTLINE AND FINAL
DEVELOPMENT PLAN ON A PART OF THE PLANNED COMMERCIAL DEVELOPMENT (PCD)
KNOWN AS MEDICAL-DENTAL CONDOMINIUMS AND APPROVAL OF A FINAL PLAT ON
LAND LOCATED AT 7807-7821 WEST 38TH AVENUE, CITY OF WHEAT RIDGE,
COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by Zephyr Development Group, Ltd., and Kunz
Construction Company for approval of an Amendment to the Outline and Final
Development Plan for a part of the Planned Commercial Development (PCD), known
as Medical-Dental Condominiums, Case No. WZ-74-09, in Wheat Ridge, Colorado,
and for approval of a Final Plat, and based upon a recommendation for approval
from the Wheat Ridge Planning Commission, and pursuant to findings made based
on testimony and evidence presented a public hearing before the Wheat Ridge
City Council, Wheat Ridge maps are hereby amended to include Case No.
WZ-84-31, titled Zephyr Medical Commons, Phases 3 and 4, as an amendment to a
part of the Planned Commercial Development Zone District, Case No. WZ-74-099
and a Final Plat is approved for the following described land:
A parcel of land in Section 23, Township 3 South, Range 69 West of the 6th
Principal Meridian; located in Jefferson County, Colorado, and described as
follows: Beginning at the southwest corner of the east half of the
southwest quarter of the southeast quarter of the southwest quarter of
Section 23, Township 3 South, Range 69 West of the 6th P.M., thence running
N 00 degrees 0714511E, along the west line of said east half, 30.00 feet to
the north right-of-way line of West 38th Avenue; thence S 89 degrees
5911511E, along said north right-of-way line, 164.38 feet to the True Point
of Beginning; thence N 00 degrees 08'19"E, 245.84 feet; thence N 89 degrees
52115"W2 164.42 feet to the west line of said east half; being also on the
east line of Echert Subdivision; thence N 00 degrees 0714511E, 69.57 feet;
thence S 89 degrees 5815511E, 164.44 feet; thence N 00 degrees 0811911E,
315.71 feet, more or less, to the north line of said east half; thence S89
degrees 57'5511E, 164.41 feet; thence S 00 degrees 08153"W, 301.37 feet;
thence N 89 degrees 59115"W, 66.00 feet; thence S 00 degrees 0814011W,
330.00 feet, more or less, to said north right-of-way line of West 38th
Avenue, thence N 89 degrees 59'15"W, 98.32 feet, more or less, to said True
Point of Beginning; containing 2.15 acres, more or less.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 4. This ordinance shall take effect 1.. days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of ~to -.a-on
this 25th day of February 1985, ordered published in full in a
newspaper of general circulation in the City of Wheat Ridge and Public Hearing
and consideration on final passage set for March 18 , 1985, at 7:30
o'clock p.m., in the Council Chambers, 7500 West 29th Avenue, Wheat Ridge,
Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a vote of
6 to 2 this 18th day of March_____, 1985.
