ORDINANCE NO. 616

TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF A SPECIAL USE PERMIT TO
ALLOW MAJOR MOTOR VEHICLE REPAIR IN A COMMERCIAL-ONE ZONE DISTRICT ON
LAND LOCATED AT 7050 WEST 38TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon application by Dave Flageolle for approval of a Special Use
Permit to allow major motor vehicle repair in a Commercial-One Zone District
in Wheat Ridge, Colorado, Case No. SUP-85-3, and pursuant to the findings made
based on testimony and evidence presented at public hearing before the Wheat
Ridge City Council, Wheat Ridge maps are hereby amended to allow a Special Use
Permit to allow major mechanical motor vehicle repair in a Commercial-One Zone
District for the following described land:
PARCEL I:
That part of Nd 1/4, NE 1/4, NE 1/4, Section 26, Township 3 South,
Range 69 West described as follows: Beginning at a point 946-1/3 feet
west of the northeast corner said NE 1/4; thence south 403 feet more
or less to a point on the north line of highway as described in Book
310 at Page 96; thence west along the north line of said highway
88-2/3 feet; thence north to a point 178.52 feet south of the north
line of said NE 1/4; thence east 28-2/3 feet; thence north 178.52 feet
to the north line of said NE 1/4; thence east 60 feet to Point of
Beginning, EXCEPT that part of the NW 1/4, NE 1/4, NE 1/4 of Section
26, Township 3 South, Range 69 West, described as follows: Beginning
at a point on the north line of said Section 26, 946-1/3 feet west of
the northeast corner of said Section; thence south 403 feet more or
less to a point on the north line of the highway described in Book 310
at Page 96, Jefferson County Records, being the True Point of
Beginning; thence west along the north line of said highway 88-2/3
feet; thence at right angles north 200 feet; thence at right angles
east 88-2/3 feet; thence south 200 feet to the True Point of
Beginning, County of Jefferson, including the northern 27 feet of
Parcel II, State of Colorado, as described as:
PARCEL II:
That part of the NW 1/4, NE 1/4, NE 1/4 of Section 26, Township 3
South, Range 69 West, described as follows: Beginning at a point on
the north line of said Section 26, 946-1/3 feet west of the northeast
corner of said Section; thence south 403 feet more or less to a point
on the north line of the highway described in Book 310 at Page 96,
Jefferson County Records, being the True Point of Beginning; thence
west along the north line of said highway 88-2/3 feet; thence at right
angles north 200 feet; thence at right angles east 88-2/3 feet; thence
south 200 feet to the True Point of Beginning, County of Jefferson,
State of Colorado.
Section 2. Conditions.
1. No outside storage of parts and/or vehicles, either under repair or to be
repaired, shall be allowed in the front area.
2. A five foot minimum distance to be required between curb cut and west
property line.
3. A six foot high screening fence to be placed around the temporary storage
area to be placed in an area behind the rear of the building for parking
of vehicles to be repaired.
Section 3. Safety Clause. The City Council hereby finds, determines, and
declares that this ordinance is promulgated under the general police power of
the City of Wheat Ridge, that it is promulgated for the health, safety, and
welfare of the public, and that this ordinance is necessary for the
preservation of health and safety and for the protection of public convenience
and welfare. The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be attained.

Section 4. Severability. If any clause, sentence, paragraph, or part of this
ordinance or the application thereof to any person or circumstances shall for
any reason be adjudged by a court of competent jurisdiction invalid, such
judgment shall not affect, impair or invalidate the remainder of this
ordinance or its application to other persons or circumstances.
Section 5. This ordinance shall take effect 15 days after final
publication.
