Series of 1g8~ TITLE: AN ORDINANCE AMENDING CHAPTER 14 OF THE CODE OF LAWS OF THE CITY OF WHEAT RIDGE BY AMENDING SECTION 14-42.2b, POSSESSION OF ALCOHOL IN PUBLIC PLACES, AND BY ADDING SECTIONS 14-42.2c, 14-42.2d, AND 14-42.e. BE IT ORDAINED BY THE CITY COUNCIL OF' THE CITY OF WHEAT RIDGE, COLORADO THAT: Section 1. Chapter 14, Section 14-42.2(b) of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: (b) It is unlawful for any person under the age of twenty-one (21) years to purchase or obtain, OR TO ATTEMPT TO PURCHASE OR OBTAIN, either directly or through an intermediary, any malt, vinous or spirituous liquor by misrepresentation of age or by any other means. Section 2. Chapter 14 of the Code of Laws of the City of Wheat Ridge, Section 14-42.2 is hereby amended by the addition of the following subsections (c), (d), and (e): (c) IT IS UNLAWFUL FOR ANY PERSON UNDER THE AGE OF EIGHTEEN (18) YEARS TO PURCHASE OR OBTAIN, OR TO ATTEMPT TO PURCHASE OR OBTAIN, EITHER DIRECTLY OR THROUGH AN INTERMEDIARY, ANY FERMENTED MALT BEVERAGE, MALT, VINOUS OR SPIRITUOUS LIQUOR BY MISREPRESENTATION OF AGE OR BY ANY OTHER MEANS. (d) IT IS UNLAWFUL FOR ANY PERSON TO PURCHASE OR PROCURE OR OBTAIN ANY FERMENTED MALT BEVERAGE, MALT, VINUOUS OR SPIRITUOUS LIQUOR WITH THE INTENT TO PROCURE FOR, SELL TO, OR PROVIDE SAID MALTED BEVERAGE TO ANY PERSON UNDER THE AGE OF EIGHTEEN (18) YEARS. (e) IT IS UNLAWFUL FOR ANY PERSON TO PURCHASE OR PROCURE OR OBTAIN ANY MALT, VINUOUS, OR SPIRITUOUS LIQUOR WITH THE INTENT TO PROCURE FOR, SELL TO, OR PROVIDE SAID MALT, VINUOUS, OR SPIRITUOUS LIQUOR TO ANY PERSON UNDER THE AGE OF TWENTY-ONE (21) YEARS. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect, impair, or invalidate the remainder of this ordinance or its application to other persons or circumstances. Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. This ordinance shall take effect one day after final publication.
