TITLE: AN ORDItIfANCE PROVIDING FOR THE APPROVAL OF A SPECIAL USE
PERMIT FOR MAJOR MECHANICAL AND AUTO BODY REPAIR FOR
AUTOMOBILES AND SMALL TRUCKS ON LAND LOCATED AT THE
NORTHWEST CORNER OF WEST I-70 FRONTA,]E ROAD NORTH AND
PARFET STREET, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON,
STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1. Upon application by James M. Sullivan for approval of a
Special Use Permit to allow Major Mechanical and Auto Body Repair
for Automobiles and Small Trucks in Wheat Ridge, Colorado, Case No.
SUP-B6-10 and pursuant to findings made based on testimony and
evidence presented at public hearing before the Wheat Ridge City
Council, a Special Ilse Permit is hereby approved for the following
described land:
A tract of land being a portion of the southeast quarter of the
southwest quarter of Section 16, Township 3 South, Range 69
West of the Sixth Principal Meridian, County of Jefferson,
State of Colorado, being more particularly described as
follows:
The east 1/2 of the property described as:
Beginning at the northwest corner of the southeast quarter of
the southwest quarter of Section 16; thence N8904314611E along
the north line of said southeast quarter of the southwest
quarter 750.07 feet to a point on the westerly right-of-way of
Parfet Street; thence 30000111211W, along said westerly
right-of-way, 992.07 feet to a point on the southerly boundary
line of the Denver and Northwestern Railroad Company
right-of-way as recorded in Book 126 Page 5B3 in the Recorder's
Office of Jefferson County; then S74007'3411W along said
southerly right-of-way, 99.96 feet to a point on the northerly
right-of-way of Interstate Highway 70 as recorded under Book
1909, Page 161 in the Recorder's Office of Jefferson County;
thence along said northerly boundary line the following two (2)
courses:
(1) Thence 589040'36"W, also being parallel with the south
line of the SE 1/4 of the SW 1/4 of Section 16, 467.55
feet to a point of curvature;
(2) Thence along a curve to the left having a central angle of
0501010411, a radius of 2060.00, an arc length of 185.30
feet to a point on the west line of said southeast
quarter, of the southwest quarter;
Thence N00001'46"4 along said west line of 1027.92 feet to the
point of beginning, containing 17.522 acres more or less.
Section 2. Conditions. This Special Use Perruit is for Major
Mechanical and Auto Body Repair for automobiles and small trucks as
an accessory use to the primary use as an automobile dealership.
Use and design of the site is subject to the adopted Craig
Chevrolet-Official Development Plan which is a condition to the
Commercial-One Zoning.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be
attained.

Section 4. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 5. This ordinance shall take effect _ 15 days after
final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 8 to
0 on this 12th day of May , 1986, ordered published
in full in a newspaper of general circulation in the City of Wheat
idge and Public 'Hearing and consideration on final passage set for
June 9 , 1996, at 7:30 o'clock p.m., in the Council
am ers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 7 to 1 , this 9th day of June -1 1936.
