AGRICULTURAL-ONE AND RESIDENTIAL-ONE TO RESIDENTIAL ONE-A
ON LAND LOCATED AT 11791 WEST 38TH AVENUE, CITY OF WHEAT
RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.

COLORADO, THAT:
Section 1. Upon application by Midwest Builders, Inc., for
approval of rezoning in Wheat Ridge, Colorado, Case No. WZ-86-12,
and pursuant to findings made based on testimony and evidence
presented at public hearing before the Wheat Ridge City Council,
Wheat Ridge maps are hereby amended to exclude from the
Agricultural-One and Residential-one Districts and to include in
the Residential One-A. District, the following described land:
Parcel A:
That portion of the Southeast One-Quarter of Section 20 and the
Northeast One-Quarter of Section 29, Township 3 South, Range 69
West of the 6th P.M., Jefferson County, Colorado, described as
follows: Beginning at the Southeast corner of said Section 20;
thence "40010'38"W along the East line of the Southeast
One-Quarter of said Section 20 a distance of 30.40 feet to a
point on the North line of West 38th Avenue (formerly Prospect
Avenue), said point being tiie true point of beginning; thence
continuing N0o10'38"W along the East line of the Southeast
One-Quarter of said Section 20 a distance of 1,301.92 feet to
the Northeast corner of the Southeast One-Quarter of the
Southeast One-Quarter of said Section 20; thence S89°29'15"W
along the North line of the Southeast One-Quarter of the
Southeast One-Quarter of said Section 20 a distance of 330.00
feet; thence S001013811E parallel to the East line of the
Southeast One-Quarter of said Section 20 a distance of 1,331.60
feet to a point on the South line of t11e Southeast One-Quarter
of said Section 20; thence S002610011E parallel to the East line
of the Northeast One-Quarter of said Section 29 a distance
of 22.54 feet to a point on the 'forth line of West 38th Avenue;

Northeast One-Quarter of Section 297 Township 3 South, Range 69

Section 2. The City Council hereby finds, determines, and declares
Chat this ordinance is promulgated under the general police power
of the City of Wheat Ridge, that it is promulgated for the health,
safety, and welfare of the public, and that this ordinance is
necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to
the proper legislative object sought to be attained.
Section 3. Severability. If any clause, sentence, paragraph, or
part ofthis ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 4. This ordinance shall take effect 15 days after final
pub ica ion.
INTRODUCED, READ, A11D ADOPTED on first reading by a vote of 8 to
0 on this 19th day of May , 1986, ordered published
in full in a newspaper of general circulation in the City of Wheat
Ridge and Public Hearing and consideration on final passage set for
June 23 , 1986, at 7:30 o'clock p.m., in the Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
