ORDINANCE NO. 678

TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROG(
AGRICULTURAL-ONE, RESIDENTIAL. TWO AND RESIDENTIAL-ONE A TO
HOSPITAL-ONE AND RESIDENTIAL-ONE A ON LAND LOCATED AT 8900
WEST 38TH AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON,
STATE OF COLORADO.
BE IT ORDAINED SY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1: Upon application by Richard Haupleman for Wide
Horizons, Inc. for approval of rezoning in 'Wheat Ridge, Colorado,
Case No. WZ-86-13 and based upon recommendation for approval, with
conditions, from the Wheat Ridge Planning Commission, and pursuant
to findings made based on testimony and evidence presented at
public hearing before the Wheat Ridge City Council, Wheat Ridge
maps are hereby amended to exclude from the Agricultural-One,
Residential-Two and Residential-One A Districts and to include in
the Hospital-One and Residential-One A Districts the following
described land:
PARCEL I: The Nest one-half of the East one-half of the
Northwest quarter of the Northeast quarter of Section 27,
Township 3 South, Range 69 West of the 6th P.M., EXCEPT those
portions conveyed to Jefferson County by instruments recorded
in Dook 438 at Page 214 and Rook 359 at Page 153•
PARCEL II: The East one-half of the Jest one-half of the
Northwest quarter of the Northeast quarter of Section 27,
Township 3 South, Range 69 'Nest of the 6th P.M., EXCEPT that
portion conveyed to Jefferson County by instrument recorded in
Book 859 at Page 153•
PARCEL III: The South 400 feet of the North 690 feet of the
East one-half of the West one-half of the West one-half of the
Northwest quarter of the Northeast quarter of Section 27,
Township 3 South, Range 69 'Rest of the 6th P.M.
PARCEL IV_: The East one-half' ,)I' the 'nest one-half of the West
one-half of the Northwest quarter of the Northeast quarter of
Section 27, Township 3 South, Range 69 West of the 6th P.M.,
EXCEPT the North 690 feet thereof and EXCEPT the South 905
feet thereof.
Excepting from the above described parcels those portions
granted to the Rocky Mountain Water Company by instrument
recorded April 4, 1884, in Book 26 at Page 75, and to the
Table Mountain Water Company by instrument recorded September
7, 1832 in Book 29 at Page 107.
Section 2. Conditions. 1. Development be in accordance with the
approved Planned Building Group.
Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be
attained.
Section 4. Severability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.

Section 5. This ordinance shall take effect 15 days after final
publication.
INTKODUCED, READ, AND ADOPTED on first reading by a vote of 7 to
p on this 23rd day of June , 1986, ordered published
in full in a newspaper of general circulation in the City of Wheat
Ridge and Public Hearing and consideration on final passage set for
Monday, July 28,
1986, at 7:30 o'clock p.m., in the Council Chambers, 7500 West 29th
Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 7 to _ 1 , this 28th day of July_ , 1986.
