I '0" BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO AS FOLLOWS: Section 1: The following part of Parfet Street, a dedicated street in the City of Wheat Ridge, County of Jefferson, State of Colorado, is hereby vacated, to wit: A parcel of land in the S.E. 1/4 of the N.W. 1/4 of section 21 T3S R69W which is a portion of that tract recorded as a Quit Claim Deed in Book 757 at Page 368 at Jefferson County, State of Colorado. Said portion of said tract to be hereby vacated and more particularly described as follows: Starting at a point which is 528 feet West and 587 feet, more or less, North of the S.F. corner of the N.W. 1/4 of Section 21, T3S. R.69W. of the 6th P.M.; thence southerly parallel with the East boundary line of said N.W. 1/4, 903 feet; thence South 64 30100" west 34.9 feet; thence North, 861 feet to the True Point of Beginning; thence continuing North on said line to a point which is 30 feet South of the centerline of W. 44th Avenue; thence West to a point which lies 54 feet West of the starting point and 30 feet South of the centerline of A. 44th Avenue; thence South Easterly to the True Point of Beginning. Except the North 3 feet thereof. provided however, that any and all utility easements presently existing in said vacated property, shall remain valid and shall not be affected by this street vacation. Section 2. Upon the vacation accomplished hereby, title to the property vacated shall revert by operation of C.R.S. 1973 43-2-302, to the abutting property owners. Section 3. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. Section 4. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the proper legislative object sought to be attained. Section 5. This ordinance shall take effect one (1) day after final publication.
