TITLE: AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING FROM PLANNED
RESIDENTIAL DEVE' OPHENT, AGRICULTURAL-Tt:'J AND INDUST3TAL TO
PLANNED COMMERCIAL DEVELOPMENT AND FOR APPROVAL OF AN OUTLINE
DEVELOPAEN'I PLAii ON LAiD LOCATED AT 4700-4800 'LABOR STREET, CITY
OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO.

THAT:
Section_1. Upon application by Baptist Home Association of the Rocky
Mountains for approval of rezoning in Wheat Ridge, Colorado, Case No.
:v'Z-87-L4, and based upon recom!aendation for approval from the Wheat Ridge
Planning Commission, and pursuant to findings made based on testimony
and evidence presented at public hearinU before the Wheat Ridge City
Council, Wheat Ridge maps are hereby amended to exclude from the Planned
Residential Development, Agricultural-Two and Industrial District and to
include in the Planned Commercial Development District, the followin;
described land:
That portion of Lots 1'3, 19, 20,21 and 22 of Lee's Subdivision,
City of Wheat Ridge, Jefferson County, Colorado, described as
follows: 3eginning at the northeast corner of said Lot 19,
said corner being the northeast corner of Section 20, Township
3 South, Rante 69 West of the 6th P.M., Jefferson County,
Colorado; thence S.0028146"E. on an assumed bearing, along the
east line of said Lot 18, a distance of 55.30 feet to a point
on the north line of that tract of land described in Book 1934
at Page 270 of the Jefferson County records; thence westerly
along said northerly line the following four (4) courses and
distances:
1) 6esterly along a curve to the right, whose radius is
5880.00 feet, whose central angle is 0036125" (whose chord
bears S.590)40114"W. a distance of 62.30 feet) for an arc
distance of 62.30 feet;
2) S.87041144"W. a distance of 506.30 feet;
3) N'.0036'16"L1, a distance of 90.16 feet to a point on the
north line of said Lot 18;
4) S.89016'25"W. along the north line of said Lot 18 a
distance of 0.06 feet to a point on the east line of that
tract of land described in Goof; 1912 at Page 796 of the
Jefferson County records;
thence N.0030140"W. along said east line a distance of 150.19
feet; thence continuing along the east line of that tract
descrioed in said Book 1912 at Page 796; ;4.16012'35"'. a
distance of 275.70 feet to a point on the west line of said Lot
20; thence N.0015'52"W. aloe; the west lines of said Lots 20,
21 and 22 a distance of 574.67 feet to a point on the south
line of that tract of land described in Book 2129 at Page 494
of the Jefferson County records; thence N.89015'23"E. along
said south line a distance of 641.75 feet to a point on the
east line of said Lot 22; thence S.0016100"E. alone the east
line of said Lots 22, 21, 20 and 19 a distance of 990.76 feet
to the point of beginning, containing 15.158 acres more or

Section 2. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare.
The City Council further determines that the ordinance bears a
rational relation to the proper legislative object sought to be
attained.
Section 3. 3everability. If any clause, sentence, paragraph, or
part of this ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of
competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this ordinance or its
application to other persons or circumstances.
Section 14. This ordinance shall take effect 15 days after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of
--7 to --0-- on this _28th__ day of Se lember_ 1937, ordered
published in full in a newspaper of general circulation in the City
of Wheat Ridge and Public Hearing and consideration on final
passae set for October 26 , 1987, at 7:30 o'clock p.m., in
the Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 8 to -0-9 this 26th day of October , 1987.
