SUBDIVI SIaN WI'rHIN THE CJ'l Y OF hHEAT RIDGE, COUNTY OF JEFFERSON, S'l'A'l'E OF COLORADO. d1 \~1r \vHEREAS a port_ion of the Roy S. Bacon Jr . Subdivision, previously approved by the Board of County Commissioners of Jefferson County, contains a dedication for West 39th Avenue adjacent to Lot 2 of said Roy S. Bacon Jr. Subdivision; and 1./3 ~ \ \i'HERf:AS a port_ion of said dedicated West 39th Avenue lies within a cuI de sac bulb and is unneeded for public roadway purposes; and WHEREAS said part of said West 39th Avenue lies within the City of Wheat, County of Jefferson, State of Colorado, and is not needed by the City for roadway or right of way purposes; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COl.ORADO AS FOI~OWS: Section 1. 'I'he followltlg portion of yJest 39th Avenue, a dedicated street wlthin the City of Wheat Ridge, County of Jef- ferson, State of Colorado, within the Roy S. Bacon Jr. Subdivi- sion, is hereby vacated, to wit: All of that parcel of land in the Southeast Quarter of Sect_ion 23, Townsnip 3 South, Range 69 West of the 6th Principal Meridian, described as being bounded as follows: On the west by the west line (extended) of Lot 2, ROY S. BACON JR'S SUBDIVISION, recorded at Plat Book 6, Page 64, in the records of Jefferson County, Colorado. On the south by the south line (extended) of Lot 3, said Plat Book 6, Page 64. On the northeast by that curve as shown as part of said Lot 2, having a radius of 45 feet. Said parcel contains 424.43 square feet more or less. PrOViding, however, that there is reserved to the City of Wheat Ridge solely for the benefit of utility providers and not for street purposes, an easement in and from property described herein ~hich easement may be utilized solely for utility instal- lation and maintenance. Section 2. Upon the vacatlon accomplished hereby, title to the property vacated shall revert by operat,ion of C.R.S. 1973, 43-2-02 to the owner of record of IJot 2, Roy S. Bacon Jr. Subdi- vision. Section 3. Safety Clause. The Ci ty Counci I hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the Ci t.y of vlheat Ridge, that it is promulgated for the health, safety and welfare of the public, and that t.his Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The Ci ty Council further determines that the Ordinance r bears a rational relation to the proper legislative object sought c! to be at,tainecl. Section 4. Severability. If any clause, sentence, para- graph, or part of this Ordinance or the applicat.ion thereof to any person or circumstances slJall for any reason be adjudged by a court of competent j~risdictlon invalid, such judgment shall not affect application to other persons or circumstances. Section 5. 'This Ordinance shall take effect 1 day after final publication.
