HomeMy WebLinkAboutOrdinance-1991-0886 INTRODUCED BY COUNCILMEMBER DAVIS Ordinance No. 886 Series of 1991 TITLE: AN ORDINANCE REPEALING AND REENACTING SECTION RESIDENCY REQUIREMENT FOR CITY COUNCIL MEMBERS OF CODE OF LAWS OF THE CITY OF WHEAT RIDGE; 7-2 THE WHEREAS, the electors of the City of Wheat Ridge, voting at the regular municipal election of November 5, 1991, amended the Charter of the City of Wheat Ridge to require that any person elected to the City Council be a resident of the District from which he is elected for a period of at least 12 consecutive months immediately preceding the date of the election; WHEREAS, in order to conform the Code of Laws of the City of Wheat Ridge to the provisions of the City's Home Rule Charter, as amended, it is necessary to repeal and reenact the existing section 7-2 of the City's Code of Laws. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE, COLORADO AS FOLLOWS: Section 1. Section 7-2 of the Code of Laws of the City of Wheat Ridge is hereby repealed and reenacted as follows: Section 7-2. Residency Requirement for City Council Members. Every registered elector eighteen (18) years of age or older on the date of election may be a candidate for, and hold the office of, City Council Member within the City; provided, however, that no person shall be eligible to hold the office of a Council Member unless he is a resident of the district from which he is elected for a period of at least twelve (12) consecutive months immediately preceding the date of the election. In the event an area is annexed into the City, any person who lives in the annexed area for a period of twelve (12) consecutive months immediately preceding the date of election shall be deemed a resident of the City, and a resident of the District and may run as a Council Member from that District. In the event that city Council boundary lines are changed, a prospective council member shall be eligible to run from the newly defined district if he has been a resident of the City and the District from which he is elected for a period of at least twelve (12) consecutive months immediately preceding the date of election. section 2. Severability. If any clause, sentence, paragraph, or part of this ordinance or the application thereof to any person or circumstances shall for any reason be adjudged by a court of competent jurisdiction invalid, such judgment shall not affect application to other persons or circumstances. section 3. Safety Clause. The City Council hereby finds, determines, and declares that this ordinance is promulgated under the general police power of the City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public, and that this ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The City Council further determines that the ordinance bears a rational relation to the property legislative object sought to be attained. Section 4. This ordinance shall become effective one day after final publication.
