TITLE: AN ORDINANCE PROVIDING FOR THE REZONING FROM PLANNED
INDUSTRIAL DEVELOPMENT DISTRICT TO A MODIFIED PLANNED
INDUSTRIAL DEVELOPMENT DISTRICT AND APPROVAL OF A
COMBINED OUTLINE AND FINAL DEVELOPMENT PLAN AND PLAT ON
LAND LOCATED AT 5190 PARFET STREET, CITY OF WHEAT RIDGE,
COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT:
Section 1: Upon application by Drake Contractors, Inc. for Edward Eid
for establishment of a planned industrial development zone district
and approval of a plan and plat in Wheat Ridge, Colorado, Case No. WZ-
92-5 and based upon recommendation for approval from the Wheat Ridge
Planning Commission, and pursuant to findings made based on testimony
and evidence presented at public hearing before the Wheat Ridge City
Council, a new Planned Industrial Development zone district is
established and a combined outline and final planned industrial
development plan and plat is hereby approved for the following
described land:
THAT PART OF THE NE 1/4 SW 1/4 OF SECTION 16, TOWNSHIP 3 SOUTH, RANGE
69 WEST OF THE 6TH PRINCIPAL MERIDIAN; LOCATED IN THE CITY OF WHEAT
RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO, AND DESCRIBED AS
FOLLOWS:
COMMENCING AT THE SOUTH 1/4 CORNER OF SECTION 16, TOWNSHIP 3 SOUTH,
RANGE 69 WEST OF THE 6TH P.M., THENCE NORTH 000 00' 00" EAST, ALONG
THE NORTH-SOUTH CENTERLINE OF SAID SECTION 16, A DISTANCE OF 2542.75'
TO A POINT ON THE SOUTHERLY RIGHT-OF-WAY LINE OF THE BURLINGTON-
NORTHERN RAILROAD R.O.W.; THENCE S 740 48' 48" W, ALONG SAID SOUTHERLY
RIGHT-OF-WAY, A DISTANCE OF 20.72 FEET TO THE TRUE POINT OF BEGINNING;
THENCE CONTINUING S 740 48' 40" W, ALONG SAID SOUTHERLY RIGHT-OF-WAY,
A DISTANCE OF 526.73 FEET TO THE EASTERLY RIGHT-OF-WAY LINE OF PARFET
STREET; AND PARALLEL TO THE SAID NORTH-SOUTH CENTERLINE OF SECTION 16,
A DISTANCE OF 170.50 FEET; THENCE N 740 48' 40" E, PARALLEL TO SAID
SOUTHERLY RAILROAD R.O.W., A DISTANCE OF 526.73 FEET, THENCE N 000 00'
00" E PARALLEL TO SAID NORTH-SOUTH CENTERLINE OF SECTION 16, A
DISTANCE OF 170.50 FEET TO SAID TRUE POINT OF BEGINNING.
Section 2. Vested Prooertv Rights. Approval of this combined outline
and final development plan and plat does not create a vested property
right. Vested property rights may only arise and accrue pursuant to
the provisions of Section 26(c) of Appendix A of the Code of Laws of
the City of Wheat Ridge.
Section 3. Safety Clause. The City Council hereby finds, determines,
and declares that this ordinance is promulgated under the general
police power of the City of Wheat Ridge, that it is promulgated for
the health, safety, and welfare of the public, and that this Ordinance

is necessary for the preservation of health and safety and for the
protection of public convenience and welfare. The City Council
further determines that the ordinance bears a rational relation to the
proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or part
of this Zoning Code or the application thereof to any person or
circumstances shall for any reason be adjusted by a court of competent
jurisdiction invalid, such judgment shall not affect application to
other persons or circumstances.
Section 5. This ordinance shall take effect
publication.

in a newspaper of general circulation in the City of Wheat Ridge and
Public Hearing and consideration on final passage set for
July 27, , 1992, at 7:30 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
