AN nRDINANCE VACATING A PORTION OF WEST 39TH AVENUE
BETWEEN HOYT COIJRT AND INDEPENOENCE COUFn (A.K.A.
INDr::PENDEI'iCE PI.ACE) IN THE FWSE HAVEN SU8[jIVISION
ADJACENT TO 3900 INDEPENDENfE COIJRT, WITHIN THE LITY
OF WHEAT RIDGE. COUNTY OF JEFFERSON, STATE OF
COLORADO.

WHEREAS a portion of the Rose Haven Subdivision, previously
approved by the Board af County Commissioners of Jefferson
County, contains a dedicat.ion for West 39th Avenue adjacent to
Lot 7 of said Rose Haven Subdivision being 3900 Independence
Court; and
WHEREAS a portion of said dedicated West 39th Avenue 1S
unneeded for public roadway purposes; and
WHEREAS sald part of said West ~9th Avenue lies within the
Lit; of Wheat, Lounty of Jefferson, State of Colorado, and is not

Township 3 South, Range 69 West described as:
The East 30 feet of that parcel of land designated as
West 39th Avenue in Rose Haven Subdivision as recorded
at Plat Book 13 Page 60 of the official records of the
County of Jefferson, State of Colorado.
Said parcel contains 750.00 square feet more or less.
Provid1ng, however. that there is reserved to the City of Wheat
Ridge solely for the benefit of the Cit'! and utility providel-s
and not for street purposes, an easement in and from propertl de-
scribed herein which easement ma'! be utilized solely fOI- st.onn
sewer, bike/walk way, and utility installation and maintenance.
