TITLE: AN ORDINANCE VACATING A PORTION OF JAY STREET (CASE NO.
WV-93-5) WITHIN THE CITY OF WHEAT RIDGE, COUNTY OF
JEFFERSON, STATE OF COLORADO ADDRESSED AS APPROXIMATELY
3490 JAY STREET.
WHEREAS, right-of-way was previously dedicated for Jay Street
approximately West 35th Avenue extended and Kendall Street; and
WHEREAS, said part of said Jay street lies within the City of
Wheat Ridge, County of Jefferson, State of Colorado, and a portion of
said street is not needed by the City for roadway or right-of-way
purposes;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO AS FOLLOWS:
Section 1. The following portion of Jay Street, a dedicated
street within the City of Wheat Ridge, County of Jefferson, State of
Colorado, is hereby vacated, to wit:
Parcel A: A parcel of land in the Northwest 1/4 of Section 25,
Township 3 South. Range 69 West of the 6th Principal Meridian, County
of Jefferson, State of Colorado described as:
Commencing at the Northwest corner of the Northeast 1/4 of the
Southeast 1/4 of the Northwest 1/4 of said Section 25, said corner
being the TRUE POINT OF BEGINNING. Thence N 89047'35" E along the
North line of said NE 1/4 SE 1/4 NW 1/4 a distance of 20 feet. Thence
S 0020'34" E parallel with and 20 feet East of the West line of said
NE 1/4 SE 1/4 NW 1/4 a distance of 83.74 feet, thence S 33053'30" W a
distance of 35.55 feet to a point on the West line of said NE 1/4 SE
1/4 NW 1/4 a distance of 113.18 feet to the TRUE POINT OF BEGINNING.
EXCEPT THE NORTH 25 FEET THEREOF.
Said parcel being 1470 square fezt, more or less.
Parcel B: A parcel of land in the Northwest 1/4 of Section 25,
Township 3 South, Range 69 West of the 6th Principal Meridian, County
of Jefferson, State of Colorado described as:
Commencing at the Northeast corner of the Northwest 1/4 of the
Southeast 1/4 of the Northwest 1/4 of said Section 25, said corner
being the TRUE POINT OF BEGINNING. Thence S 89047'35" W along the
North line of said NW 1/4 SE 1/4 NW 1/4 a distance of 20 feet. Thence
S 0020'34"E parallel with and 20 feet West of the east line of said NW
1/4 SE 1/4 NW 1/4 a distance of 142.61 feet, thence N 33053'30" E a
distance of 35.55 feet to a point in the East line of said~W 1/4 SE
1/4 NW 1/4 a distance of 113.18 feet to the TRUE POINT OF BEGINNING.
EXCEPT THE NORTH 25 FEET THEREOF.
Said parcel being 2050 square feet, more or less.

Section 2. Upon the vacation accomplished hereby, title to the
property vacated shall revert by operation of C.R.S. 1973, 43-2-02 to
the adjacent property owners of record. More specifically, Parcel A
described above shall revert to the owner of property addressed as
6200 West 35th Avenue and Parcel B described above shall revert to the
owner of property addressed as 3490 Jay street.

Section 3. Safety Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under the
general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public, and
that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The
City Council further determines that the ordinance bears a rational
relation to the proper legislative object sought to be attained.
Section 4. Severability. If any clause, sentence, paragraph, or
part of this Ordinance or the application thereof to any person or
circumstances shall for any reason be adjudged by a court of competent
jurisdiction invalid, such judgment shall not affect, impair or
invalidate the remainder of this ordinance or its application to other
persons or circumstances.
Section 5. This Ordinance shall take effect one day after final
publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of ~ to ~
on this 27th day of September , 1993, ordered published in full
in a newspaper of general circulation in the City of Wheat Ridge and
Public Hearing and consideration on final passage set for Monday,
October 25 , 1993, at 7:30 o'clock p.m., in the Council Chambers,
7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by a
vote of 8 to 0 ,this 25th day of October , 1993.
