TITLE:
AN ORDINANCE AMENDING SECTION 2-53(d) OF THE WHEAT
RIDGE CODE OF LAWS, CONCERNING VOTING RULES FOR THE
BOARD OF ADJUSTMENT, AND DECLARING AN EMERGENCY

COLORADO, AS FOLLOWS:
Section 1. Section 2-53(d) of the Wheat Ridge Code of Laws is
amended to read:
(d) Notwithstanding any other provision
in this section, the following voting rules
shall be in effect for all matters requiring
decision by the board of adjustment TO GRANT
ANY VARIANCE, WAIVER OR TEMPORARY BUILDING OR
USE PERMIT UNDER SECTION 2-61 (a) OR (b) (or
for any matter requiring decision by the
planning commission or the city council under
Section 26-6(D) of the Zoning Ordinance of the
city) :

ALL OTHER ACTIONS SHALL BE TAKEN BY MAJORITY
VOTE OF THE MEMBERS PRESENT,
Section 2, Emerqencv Declared, Pursuant to Charter Section
5.13, the City Council hereby finds, determines, and declares that
this Ordinance is promulgated under the general police power of the
City of Wheat Ridge and that this Ordinance is necessary for the
immediate preservation of public peace, health and safety. Spe-
~ifically, the immediate effectiveness of this Ordinance i~
necessary to resolve an apparent conflict between Sections 2-53(d)
and 2-61 (d) (3) of the Code of Laws which affects the present
ability of the Board of Adjustment to take effective actions.

Section 3. Severabilitv. If any clause, sentence, paragraph,
or part of this Ordinance or Application thereof to any person or
circumstances shall for any reason be judged by a court of compe-
tent jurisdiction invalid, such judgment shall not affect, impair
or invalidate the remainder of this Ordinance or its application to
other persons or circumstances.
Section 4, Effective Date. Pursuant to Charter Section 5.13,
this Ordinance shall take effect upon final passage.
INTRODUCED, READ, AND ADOPTED as an emergency ordinance by a
vote of 6 to 0 on this 10th day of June , 1996, ordered
published in full in a newspaper of general circulation in the City
of Wheat Ridge.
