TITLE:
AN ORDINANCE PROVIDING FOR THE APPROVAL OF REZONING
FROM COMMERCIAL-ONE (C-1) TO RESIDENTIAL-TWO (R-2) AND
RESIDENTIAL-ONE C (R-1C) PROPERTIES GENERALLY LOCATED
ALONG WEST 29TH AVENUE BETWEEN SHERIDAN BLVD. ON THE
EAST, AND FENTON ST ON THE WEST, CITY OF WHEAT RIDGE,
STATE OF COLORADO.
WHEREAS, the City Council adopted specific procedures for City-
initiated Large Area-Multlple property rezoning by adopting
Ordinance No, 1040, Series of 1996, and
WHEREAS, Resolution No. 1556 was subsequently adopted by City
Council which initiated a Large Area-Multiple Property rezoning
procedure by referring the proposal to Planning Commission for a
public hearing and recommendation, and
WHEREAS, the Wheat Ridge Planning Commission held a public
hearing on October 3, 1996 and, pursuant to findings made based
on testimony and evidence presented, adopted a resolutlon
recommending approval, with modifications, of Case No. WZ-96-8.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WHEAT RIDGE, COLORADO, THAT:
Section 1. Upon consideration of the recommendation of the Wheat
Ridge Planning Commission and pursuant to findings made based
upon further testimony and evidence presented at a public hearing
before the Wheat Ridge City Council, Wheat Ridge Official Zoning
Maps are hereby amended to exclude properties from Commercial-One
(C-1) and to include those properties in Resldential-Two (R-2)
and Residential-One C (R-1C) in accordance wlth Exhibit A,
attached hereto and incorporated herein, said properties being
located within Section 25, Township 3, Range 69 West, City of
Wheat Ridge, County of Jefferson, State of Colorado.
Section 2. Safetv Clause. The City Council hereby finds,
determines, and declares that this ordinance is promulgated under
the general police power of the City of Wheat Ridge, that it is
promulgated for the health, safety, and welfare of the public,
and that this ordinance is necessary for the preservation of
health and safety and for the protection of public convenience
and welfare. The City Council further determines that the
ordinance bears a rational relation to the proper legislative
object sought to be attained.

Section 3. Severability. If any clause, sentence, paragraph, or
part of this Zoning Code or the application thereof to any person
or Clrcumstances shall for any reason be adjusted by a court of
competent jurisdiction invalid, such judgment shall not affect
application to other persons or circumstances
Section 8. This ordinance shall take effect
final publication.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7
to 0 on this 4thciay of November , 1996, ordered published
in full in a newspaper of general circulation in the City of
Wheat Ridge and Public Hearing and consideration on final passage
set for November 25 , 1996, at 7:00 o'clock p.m., in the
Council Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado
