AN ORDINANCE PROVIDING FOR THE APPRO V AL OF A SPECIAL USE
PERMIT TO ALLOW GOVERNMENTAL BUILDINGS WITH OUTSIDE
STORAGE AND REPAIR F ACILlTIES IN AN AGRICUL TURAL- ONE
DISTRICT ON LAND LOCATED AT 11220 WEST 45TH AVENUE, CITY OF
WHEA T RIDGE. COUNTY OF JEFFERSON, STATE OF COLORADO.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT
Section 1. Upon apphcatlon by City of Wheat RIdge for approval of a SpeCial Use Permit, m
Wheat Ridge, Colorado, Case No SUP-96-6, and pursuant to findings made based on testimony
and evidence presented at public heanng before the Wheat Ridge City Council, a SpeCial Use
Permit to allow governmental bUIldings WIth outside storage and repair faCilities is hereby
granted in an A-I zone for the following described land:
That portIOn of the west 255 feet of the East half, Northwest Quarter of SectIOn 21,
Township 3 south, Range 69 west of the 6th Pnnclpal Mendian described as follows.
Begmmng at a pomt on the west Ime of the East half, Northwest Quarter of said section
21, said pomt bemg 104909 feet North of the South line of the East half, Northwest
Quarter of said Section 21; Thence Easterly parallel to said South Ime a distance of 255
feet; Thence northerly parallel to the West line of the East half, Northwest Quarter of said
Section 21 a distance of 310 feet to a point 710 feet North of the North lme of the County
Road known as the North Golden and Denver Road or West 44th avenue, thence
Westerly parallel to the north line of said County Road a distance of 255 feet to a point
on the West lme of the East Half, Northwest Quarter of said section 21, thence southerly
along the West lme of the East Half, Northwest Quarter of said section 21 a distance of
310 feet to the pomt of beginmng, County of Jefferson, State of Colorado. And,
That portIOn of the East 2 feet of the East Half, Northwest Quarter, Southwest Quarter,
Northwest Quarter of sectIOn 21, township 3 south, Range 69 west ofthe 6th Pnnclpal
Mendian described as follows. Beginnmg at a pomt on the East line of the East Half:

NW 1/4 of Section 21, Township 3 South, Range 69 West, of the 6th P.M. County of
Jefferson, State of Colorado And,
The North 250 feet of the East Y, of the East 2/3 of the East Y, of the NE 1/4, SW 1/4,
NW 1/4 of Section 21, Township 3 South, Range 69 West except the east 2 feet thereof
previously conveyed by deed recorded m Book 2183 at Page 771, County of Jefferson.

SectIOn 2. Vested Property RI~hts. Approval of this Special Use Permit does not create a vested
property right. Vested property rights may only anse and accrue pursuant to the proviSIOns of
SectIOn 26 of Appendix A of the Code of Laws of the City of Wheat Ridge
SectIOn 3. Safety Clause. The City Council hereby finds, determines, and declares that this
ordmance is promulgated under the general police power of the City of Wheat Ridge, that It is
promulgated for the health, safety, and welfare of the public and that this ordmance IS necessary
for the preservation of health and safety and for the protectIOn of public convenience and welfare
The City Council further determmes that the ordmance bears a rational relatIOn to the proper
legislative object sought to be attained.
SectIOn 4. ThiS ordmance shall take effect ~ days after final publicatIOn.
