AN ORDINANCE ZONING CERTAIN PROPERTY (11721 WEST 52ND
AVENUE - PARCEL 2) WITHIN THE CITY OF WHEAT RIDGE,
COLORADO, AGRICULTllRAL-TWO PURSUANT TO SECTION 26-6(C)
OF THE WHEAT RIDGE CODE OF LAWS AND AMENDING THE
ZONING ORDINANCE AND MAP TO CONFORM THEREWITH.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE.
COLORADO, THAT
SectIOn 1 FindIngs of Fact.
(A) Application has been made for zomng certain property described on attached ExhibIt
A, within the City of Wheat Ridge, Colorado, Agncultural-Two pursuant to Section
26~6( C) of the Wheat Ridge Code of Laws.
(B) Publtc notice has been given of such zomng by one pubhcatlOn m the Wheat RIdge
Transcnpt, a newspaper of general circulatIOn WIthIn the City, and the offiCIal
newspaper of the City, at least tifteen (15) days prior to the heanng of such zonmg
(C) Wntten notice was sent by certified maIl to all adjacent property owners and owners
of the property under consideration, at least fifteen (15) days pnor to the publtc
heanng
(D) Notice of such proposed hearing was posted on the property for fifteen (15)
consecutive days prior to sald heanng,
(E) A need eXlsts for zoning ofthls propel1y Agncultural-Two
SectIOn 2, The property described m attached Exhibit A IS hereby zoned Agncultural~ Two,
subject to the condltions set forth below
(A) The property shall only be used as proVided In SectIOn 26~19 of the Wheat Ridge
Code of Laws, except for any special conSideratIons set out In the AnncxatlOn
Agreement attached to the Annexation Ordmance.
(B) The following A~2 uses shall be deleted from the permitted pnnClpal uses and
permltted accessory uses on the property'
(1) Section 26~19 (B)(8)
(2) Keepmg of SWIne
(3) Sectlon 26~19 (C)(8)
(4) SectlOn26~19(C)(9)
SectIOn 3 The zomng ordmance and zonmg map of the City of Wheat RIdge, Colorado are
hereby amended to conform wIth the zoning change to the property

SectIOn 4 Safety Clause. The City CouncIl hereby finds, determmes, and declares that thIs
ordmance IS promulgated under the general polIce power of the CIty of Wheat Ridge, that It IS
promulgated for the health, safety, and welfare of the public, and that this ordmance IS necessary for
the preservation of health and safety and for the protection of public convenience and welfare The
CIty CouncIl further determines that the ordinance bears a ratIOnal relation to the proper legIslatIve
objectIve sought to be attamed,
SectIOn 5 SeverabIlIty If any clause, sentence, paragraph, or part of thIS ordmance or the
applIcatIOn thereof to any person or circumstances shall for any reason be adjudged by a court of
competent]unsdlctlOn mvalId, such Judgement shall not affect applIcatIon to other persons or
circumstances.
SectIOn 6 This ordmance shall become effectIve fifteen (15) days after final publIcation.
