AN ORDINANCE ZONING CERTAIN PROPERTY (5220 SWADLEY)
WITHIN THE CITY OF WHEAT RIDGE, COLORADO, AGRICULTURAL-
TWO PURSUANT TO SECTION 26-6(C) OF THE WHEAT RIDGE CODE
OF LAWS AND AMENDING THE ZONING ORDINANCE AND MAP TO
CONFORM THEREWITH.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE.

(A) ApplIcatIOn has been made for zomng certam property described on attached ExhIbIt
A, wlthm the CIty of Wheat RIdge, Colorado, Agncultural- Two pursuant to SectIOn
26~6(C) of the Wheat RIdge Code of Laws,
(B) Public notIce has been given of such zonmg by one publIcatIon in the Wheat RIdge
Transcnpt, a newspaper of general cIrculatIOn wIthin the CIty, and the official
newspaper of the CIty, at least fifteen (15) days pnor to the hearing of such zoning
(C) Wntten notIce was sent by certIfied maIl to all adjacent property owners and owners
of the property under consIderatIOn, at least fifteen (15) days pnor to the publIc
heanng
(D) NotIce of such proposed heanng was posted on the property for fifteen (15)
consecutIve days pnor to SaId heanng.
(E) A need eXIsts for zomng of thIs property Agncultural~Two
SectIOn 2 The property described in attached ExhibIt A is hereby zoned Agncultural~ Two,
subject to the condItIons set forth below
(A) The property shall only be used as proVIded m SectIon 26-19 of the Wheat RIdge
Code of Laws, except for any speCIal conSIderations set out m the AnnexatIon
Agreement attached to the AnnexatIOn Ordinance,
(B) The following A~2 uses shall be deleted from the permitted pnnclpal uses and
permItted accessory uses on the property'

Section 3 The zomng ordmance and zomng map of the City of Wheat Ridge, Colorado are
hereby amended to conform with the zoning change to the property, I--
SectIon 4 Safety Clause The City Council hereby finds, determmes, and declares that this
ordmance IS promulgated under the general pohce power of the City of Wheat Ridge, that It IS
promulgated for the health, safety, and welfare of the public, and that this ordmance IS necessary for
the preservatIOn of health and safety and for the protection ofpubhc convenience and welfare The
City Council further determines that the ordinance bears a ratIOnal relation to the proper legislative
objective sought to be attamed,
Section 5 Severability If any clause, sentence, paragraph, or part of this ordmance or the
applIcatIOn thereof to any person or circumstances shall for any reason be adjudged by a court of
competent Jurisdiction mvahd, such judgement shall not affect applicatIOn to other persons or
circumstances.
Section 6 This ordmance shall become effective fifteen (15) days after final publicatIOn.
