WHEREAS, nght~of~way was previously dedIcated for W 33'J Avenue between Parfet
Street and Pierson Street; and
WHEREAS, saId part of saId W 33'J Avenue lIes withm the CIty of Wheat RIdge.
County ofJefferson, State of Colorado, and a portion of the dedicated right~of~way IS not needed
for pedestnan or emergency access,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT

Wheat Ridge, County of Jefferson, State of Colorado, is hereby vacated to WIt:
The northern 20 feet of DefIert SubdIVISIon as recorded m the offiCIal records of
JetTerson County, State of Colorado at Plat Book 44, Page 38, and, the northern 20 feet of
Applewood HIlls SubdiVIsion as recorded In the offiCIal records of Jefferson County,
State of Colorado at Plat Book 95, Page 7
SectIon 2, Vested Propertv RIghts, Upon the vacation accomplished hereby, title to the
property vacated shall revert to the adjacent property owner of record pursuant to C ,R.S 43~2~30,

thIS ordmance IS promulgated under the general polIce power of the CIty of Wheat RIdge, that It
IS promulgated for the health, safety, and welfare of the publIc and that thIS ordmance IS
necessary for the preservatIOn of health and safety and for the protectIOn of publIc convemence
and welfare, The CIty CounCIl further determmes that the ordmance bears a ratIOnal relatlOn to
the proper legislatIve object sought to be attamed.
SectIOn 4. SeverabllItv. If any clause, sentence, paragraph, or part of thIS Zoning Code or
the applIcatIOn thereof to any person or circumstances shall for any reason be adjusted by a court
of competent Junsdlctlon mvalId, such Judgment shall not affect applIcatIOn to other persons or
CIrcumstances,
