TITLE:
AN ORDINANCE AMENDING THE WHEAT RIDGE CODE
OF LAWS, SECTION 2-53(D), CONCERNING VOTING
RULES FOR THE BOARD OF ADJUSTMENT, CITY OF
WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF
COLORADO.
WHEREAS, SectiOn 2.53(d) of the Wheat Ridge Code of Laws govern votmg rules for the
Board of AdJustment: and
WHEREAS, SectiOn 2.53(d) does not refer to the votmg rules for deciSIOn by the Board of
AdJustment on requests for lllterpretatiOns of the zonlllg and other codes and requests for floodplalll
speCial exceptIOn permits.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WHEAT RIDGE, COLORADO, THAT
Section 1. SectiOn 2 53(d) of the Wheat Ridge Code of Laws IS amended to read.
(d) Notwlthstandlllg any other proviSiOn in this sectiOn, the fO]]owlllg
voting rules shall be in effect for all matters reqUlnng deciSiOn by the board
of adJustment to grant any vanance, Waiver, temporary buildmg or use
permit, ANY INTERPRETATION OR FLOODPLAIN SPECIAL
EXCEPTION PERMIT under SectIOn 2.6I(a) or (b) (or for any matter
requmng deCISIOn by the plannlllg commissiOn or the city counCil under
SectiOn 26-6(D) of the Zonlllg Ordlllance of the city)

All other actiOns shall be taken by maJonty vote of the members present.
Section 2. Safety Clause. The City Council hereby finds, determines, and declares that thiS
Ordmance IS promulgated under the general police power of the City of Wheat Ridge, that It is
promulgated for the health, safety, and welfare of the public and that thiS ordlllance lS necessary for
the preservatiOn of health and safety and for the protection of public convemence and welfare The
City Council further determmes that the Ordmance bears a ratiOnal relation to the proper legIslative
obJect sought to be attained.
Section 3. Severability: Conflictinl: Ordinances Repealed. If any section, subsectiOn, or
clause of this Ordinance shall be deemed to be unconstItutional or otherwise invalid, the validity of
the remamlllg sections, subsectiOns and clauses shall not be affected thereby All other ordmances
or parts of ordlllances In conflict With the provIsions of this ordmance are hereby repealed.
Section 4. Effective Date. This Ordlllance shall take effect 15 days after final publication
as provided by Section 5 11 of the Charter
