TITLE. AN ORDINANCE AMENDING THE WHEAT RIDGE CODE OF
LAWS, RENAMING THE ECONOMIC DEVELOPMENT AND
REVITALIZATION COMMISSION.
WHEREAS, the City of Wheat Ridge has created an urban renewal authority
pursuant to C.R S. Section 31-25-101, et seq.; and
WHEREAS, the present name of the authority is the Wheat Ridge Economic
Development and Revitalization Commission; and
WHEREAS, the City Council deems it more appropriate to characterize the
Commission in its correct status as an urban renewal authority.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO:
Section 1. Section 25-23 of the Wheat Ridge Code of Laws is amended to
read a:

AUTHORITY - Rights and duties generally.

Revitaliz::ltion Commission URBAN RENEWAL
AUTHORITY is hereby organized and established. Such
commission is hereby vested with all of the rights
contained, and is authorized to carry out all of the duties
and functions as provided in the Urban Renewal Law
[C.R.S. !j 31-25-101, et seq.,]. as it now exists or as
amended in the future, unless such powers and
authorities are limited or constrained by or within any
approved urban renewal plan; provided, however, that the
use of eminent domain shall not be undertaken without
the approval of the majority of the city council having
first been obtained.
Section 2. Section 25-24 of the Wheat ridge Code of Laws IS amended to

Sec. 25-24. Same-Appointment of members; number.
The commission AUTHORITY shall consist of
eleven (11) commiscioncrc MEMBERS, two (2) of such
commisclonerc MEMBERS being from each of the
existing, or hereafter altered, city council districts, and
one (1) commicsionor MEMBER to serve at large. Each
appointment to the commiccion AUTHORITY shall be
made by the mayor subject to approval by majority of the
entire city council. The term of office of each
commiccioner MEMBER shall be five (5) years. Any
commission MEMBER who shall change his personal
residence to an address outside the city or outside the
district he represents shall cease to be a member of the
commiccion AUTHORITY and his seat shall automatically
be deemed vacant as of the date on which he ceased to
be a resident the city or of the district A members
whose term has expired shall continue to hold office until
his successor has been appointed and has qualified.
Terms of office shall be staggered so that the term of at
least one (1) commissioner MEMBER shall expire each
year.
Section 3. Safety Clause. The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare The City Council
further determines that the Ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 4. Severability; Conflictina Ordinances Repealed. If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses
shall not be affected thereby. All other ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
Section 5. Effective Date. This Ordinance shall take effect fifteen days after
final publication, as provided by Section 5.11 of the Charter

INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to 0 on
this 22nd day of May, 2000, ordered published in full in a newspaper of general
circulation in the City of Wheat Ridge and Public Hearing and consideration on final
passage set for June 12 , 2000, at 7.00 o'clock p.rn , in the Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
READ, ADOPTED AND ORDERED PUBLISHED on second and final reading by
a vote of 8 to 0 ,this 12th day of June , 2000.
