TITLE. AN ORDINANCE AMENDING CHAPTER 5 OF THE WHEAT
RIDGE CODE OF LAWS BY ADDING SECTION 5-83 TO
PROVIDE VIOLATION PENALTIES FOR PREVIOUSLY
ADOPTED TECHNICAL CODES
WHEREAS, pursuant to C.R.S. s31-16-201, et seq., the City of Wheat
Ridge (the "City") possesses the authority to adopt codes by reference,
WHEREAS, by Ordinance Number 1996-1039 the City has adopted by
reference the following documents, all of which are "codes", as that term is
defined in C R S S 31-16-201(2):
The Uniform Building Code, 1997 Edition, by the International Conference of
Bl<Jilding Officials,
The Uniform Housing Code, 1997 Edition, by the International Conference of
Building Officials,
The Uniform Mechanical Code, 1997 Edition, by the International Conference
of Building Officials;
The Uniform Plumbing Code, 1997 Edition, by the International Association
of Plumbing and Mechanical Officials;
The Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition,
by the International Conference of Building Officials,
The National Electrical Code, 1993 Edition, by the National Fire Protection
Association;
WHEREAS, copies of the above-referenced codes are available for public
inspection andlor purchase in the Office of the Wheat Ridge City Clerk;
WHEREAS, pursuant to C R S s 31-16-204, the City must fully set forth
penalty clauses for the above-referenced codes; and
WHEREAS, the City desires to provide penalty clauses for each of the above-
referenced codes previously adopted by reference

NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WHEAT RIDGE, COLORADO THAT:
Section 1. Section 5-83. of Chapter 5, Article 3 of the Wheat Ridge Code
of Laws, formerly Reserved, is hereby adopted to read: "Technical Code Violation
Penalties"
SEC 5-83. TECHNICAL CODE VIOLATION PENALTIES.
A person, firm, corporation, partnership or any other entity who
violates any of the Technical Codes contained in this Article, as such
violations are defined in each of the respective codes and its
amendment(s), may be punished by a fine of not more than one
thousand dollars ($1,000), or by imprisonment for a period not
exceeding one year, or both such fine and imprisonment; provided
however, that no person under the age of eighteen (18) years shall be
subjected to imprisonment for violation of any provision of a Technical
Code contained in this Article. Each day that a violation continues
shall be deemed a separate offense. The penalties provided in this
section are intended to apply exclusively and solely to the technical
codes contained in this Article and do not rescind, amend or otherwise
affect any other penalty provision of this Chapter.
Section 2. Safety Clause. The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the
City of Wheat Ridge, that it is promulgated for the health, safety, and welfare of
the public and that this Ordinance is necessary for the preservation of health and
safety and for the protection of public convenience and welfare. The City Council
further determines that the Ordinance bears a rational relation to the proper
legislative object sought to be attained.
Section 3. Severability; Conflictina Ordinances Repealed If any section,
subsection or clause of this ordinance shall be deemed to be unconstitutional or
otherwise invalid, the validity of the remaining sections, subsections and clauses
shall not be affected thereby All other ordinances or parts of ordinances in conflict
with the provisions of this ordinance are hereby repealed.
Section 4. Effective Date This Ordinance shall take effect fifteen days after
final publication, as provided by Section 5.11 of the Charter.
INTRODUCED, READ, AND ADOPTED on first reading by a vote of 7 to
o on this 13th day of November , 2000, ordered published in
full in a newspaper of general circulation in the City of Wheat Ridge and Public
Hearing and consideration on final passage set for December 11 , 2000, at
7.00 o'clock pm, in the Council Chambers, 7500 West 29th Avenue, Wheat
Ridge, Colorado.
