TITLE.
AN ORDINANCE SUBMITTING A PROPOSED AMENDMENT TO
THE WHEAT RIDGE HOME RULE CHARTER TO THE VOTERS
OF THE CITY PURSUANT TO CHARTER SECTION 16 8(b),
CONCERNING THE OFFICE OF CITY CLERK.
WHEREAS, Section 16.8(b) of the Charter permits the City Council to initiate
charter amendments, and
WHEREAS, the Council wishes to place before the voters at the November,
2002 general election a ballot measure to provide for appointment of the City Clerk,
rather than by election
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, AS FOLLOWS
Section 1 Pursuant to Charter Section 16.8(b), the following proposed
amendment to the Wheat Ridge City Charter is hereby submitted to the voters of the
City for their consideration at the general election to be held on November 5, 2002:
Amend Section 3.7 of the Charter as follows:
Sec. 3.7. Election of City Clerk.
EFFECTIVE NOVEMBER 4, 2003, OR UPON A
VACANCY IN THE OFFICE OF CITY CLERK, WHICHEVER
FIRST OCCURS, AND NOTWITHSTANDING CHARTER
SECTION 3 11, the City Clerk shall be APPOINTED BY THE
CITY MANAGER AS A DEPARTMENT HEAD, WITH
DUTIES AS SPECIFIED BY THE CITY MANAGER OR BY
ORDINANCE. elected by a m::ljority vote of the electors of
the City of Whe3t Ridge at e3ch general municipal election,
and shall have the same qualifications as members of the
council. Commencing with the general municipal election
held on the first Tuesday after the first Monday in
November, 1999, his term of office shall be for four (4) years
and shall commence on his taking the oath of office at the
ensuing org::mization31 meeting of the city council held 3fter

the election in the year elected and shall continue during the
term for which he shall have beon elected until his
successor shall have been elected and duly qualified.
Repeal Charter Section 3.8.
Revise the organizational chart at Charter Section 1.4 accordingly
Section 2 Ballot Title The ballot title for the proposed Charter Amendment
shall read as follows
SHALL THE HOME RULE CHARTER OF THE CITY OF WHEAT RIDGE, COLORADO,
BE AMENDED TO PROVIDE FOR APPOINTMENT OF THE CITY CLERK AS A
DEPARTMENT HEAD BY THE CITY MANAGER?
Section 3 Safety Clause The City Council hereby finds, determines, and
declares that this Ordinance is promulgated under the general police power of the City
of Wheat Ridge, that it is promulgated for the health, safety, and welfare of the public
and that this Ordinance is necessary for the preservation of health and safety and for
the protection of public convenience and welfare. The City Council further determines
that the Ordinance bears a rational relation to the proper legislative object sought to be
attained
Section 4 Severability If any clause, sentence, paragraph, or part of this
Ordinance or application thereof to any person or circumstances shall for any reason
be judged by a court of competent jurisdiction invalid, such judgment shall not affect,
impair or invalidate the remainder of this Ordinance or its application to other persons
or circumstances
Section 5 Effective Date, This Ordinance shall take effect fifteen days after final
publication, as provided by Section 5 11 of the Charter
INTRODUCED, READ, AND ADOPTED on first reading by a vote of -L- to -1L
on this 22nd day of July, 2002, ordered published in full in a newspaper of
general circulation in the City of Wheat Ridge and Public Hearing and consideration on
final passage set for August 12 ,2002, at 700 o'clock pm., in the Council
Chambers, 7500 West 29th Avenue, Wheat Ridge, Colorado.
