TITLE:
AN ORDINANCE AMENDING AND ADOPTING THE 2002
NATIONAL ELECTRICAL CODE AND ADOPTED IN
CHAPTER 5 OF THE CODE OF LAWS OF THE CITY OF
WHEAT RIDGE, RELATING TO BUILDINGS AND
BUILDING REGULATIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,
COLORADO, THAT
Section 1. Section 5-77 of the NatIOnal Electrical Code, inclusiye of the Code of Laws of
the City of Wheat RIdge IS hereby amended as follows
(a) Adopted, The NatIOnal Electrieal Code, t993- 2002 EdItIOn, eopynght by the
National Fire ProtectIOn ASSOCIatIon, Batterymarch Park, Qumcy, Massachusetts, 02269,
IS hereby adopted by referenee thereto and Illcorporated into thIS chapter as though fully
set out herein as the electncal code of the city Except as otherwise proYlded m this
chapter, such code is adopted m full, mcluding the index and appendix eontamed therein.
One copy of saId NatIOnal Electncal Code shall be filed m the office of the elty clerk and
may be Il1spected dunng regular bus mess hours,
(b) Amendments. The NatIOnal Electncal Code, adopted by this sectIon IS hereby
amended as follows (sectIon numbers refer to section numbers of the NatIOnal Electrical
Code)
SectIon J I 0-2(b) 310.2(b)ls amended by addmg a new sentence to read
"Alummum conductors under sIze 8 are not allowed,"
SeetlOn 3-3-6-=5, 334.12, "Uses Not PermItted," IS amended by the addItIon of the followmg
paragraph fe7 (B)
"fe7 (B) These types shall not be used m any group A, B, E, F, H, L M, or S or R-l
oecupancy (as defined m the Uniform BllIldmg Code, 1997 Edition) "
Section 2. Preyious Amendments, All prevIOus amendments to Section 5 of the Code of
Laws shall remallllll effeet unless otherwise amended as part of this ordll1ance
Section 3, Safety Clause. The CIty Councll hereby finds, determmes, and declares that
this ordmanee is promulgated under the general polIce power of the CIty of Wheat RIdge, that It
IS promulgated for the health, safety, and welfare of the publIc and that this ordmanee IS
necessary for the preservation of health and safety and for the protection of public eonvemence
and welfare, The City Council further determmes that the ordmance bears a ratIOnal relatIOn to
the proper legislative object sought to be attamed.
Section 4, Seyerabll1ty, If any clause, sentenee, paragraph, or part of this Zoning Code
or the apphcatlon thereof to any person or circumstances shall for any reason be adjusted by a
court of competent JUrisdictIOn myalId, such Judgment shall not affect application to other
persons or elrcumstanees,
Section 5. SupersessIOn Clause, If any proyislOn, requirement or standard estabhshed by
thiS Ordinance IS found to conflict with simIlar proyislOns, reqUIrements or standards found
elsewhere III the Code of Laws of the CIty of Wheat Ridge, whIch are III eXistence as of the date
of adoptIOn of thiS Ordmance, the proYlslons, requIrements and standards herem shall supersede
and prevail
Section 6. This ordinance shall take effect 15 days after final pubhcation.
