RESOLUTION NO. 606
Series of 1978
TITLE: RESOLUTION APPROVING THE PURCHASE PRICE, TERMS AND CONDITIONS FOR
THE ACQUISITION OF THE MUGELE PROPERTY COMMONLY KNOWN AS LOTS 2
AND 3, W. 44TH AVENUE VILLAGE SUBDIVISION, COUNTY OF JEFFERSON,
STATE OF COLORADO, FOR PARKS AND OPEN SPACE PURPOSES.
WHEREAS, the Mugele property, commonly known as Lots 2 and 3,
W. 44th Avenue Village Subdivision, County of Jefferson, State of Colorado,
and situated north of W. 44th Avenue and easterly of Miller Street, consisting
of approximately 12.22 acres, more or less, has been offered for sale to the
City by the owner, and
WHEREAS, a qualified appraisal report has been secured on this property
by the Jefferson County Open Space Director at the request of the City of
Wheat Ridge, and
WHEREAS, the owner has agreed to sell the property to the City under
the Jefferson County Open Space program at its appraised market value, and
WHEREAS, the City Council by means of Resolution 578, Series of 1978,
requested the Board of County Commissioners through the Jefferson County Open
Space Fund to purchase the property for parks and open space purposes subject
to final approval of the purchase price, terms and conditions of the purchase
by the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Wheat Ridge, that the Board of County Commissioners be hereby requested to
purchase the Mugele property for parks and open space purposes from the Wheat
Ridge allocation of Jefferson County Open Space funds at a total price of
$319,500;
AND BE IT FURTHER RESOLVED that the payment for this property be
made in a manner mutually satisfactory to the owner and Jefferson County
in annual amounts to be set forth in the purchase contract.

AND BE IT FURTHER RESOLVED that the acquisition of this property be
