TITLE: RESOLUTION AUTHORIZING AN APPRA.ISAL, NEGOTIATION }'l.ND
ACQUISITION OF THE PROPERTY LOCATED AT 10135 W. 38TH
AVENUE III WHEAT RIDGE, ALSO KNOWN AS OSBAUGH PROPERTY.
WHEREAS, the City is interested in the acquisition of land
for dual public uses of open space and storm drainage along Lena
Gulch; and
v7HEREA.S, the City shows in the Comorehensive Development
Plan a trail along Lena Gulch which also connects to Clear Creek in
the vicinity of Kipling Street; and
WlIEREAS, the City Comprehensive Development Plan shows a
green Parks and ODen Space designation on the Future Land Use Map
for the total Lena Gulch corridor and Clear Creek corridor; and
WHEREAS, the City is working with the Urban Drainage and
Flood Control District to construct storm drainage improvements
along Lena Gulch, which inprovements contain a trail and a grass
lined channel, wherever possible, to ~aintain t~e open character
of the gulch area; and
WHERFAS, Jefferson County Open Space Funds can be used for
buying open spaces and providing trails; and
WHEREAS, the Urban Drainage and Flood Control Funds can be
used for the purpose of buying structures; and
WHEREAS, the comoletion of this project will require the
donation or ourchase of land In fee or the donation or purchase of
easements of portions of the property at 10135 W. 38th Avenue; and
WHEREAS, in the event a donation is not agreed to by the
owner, then it will be necessary to negotiate a fair and equitable
price based on a qualified appraisal for the property needed by
the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Wheat Ridge, that City Staff be authorized to request from
the o\-'Der of the propertv at 10135 'd. 38th Avenue the donation in
fee or In easements, as required, of property needed by the City at
10135 H. 38th Avenue; and
BE IT FURTHER RESOLVED by the City Council of the City of
Wheat Ridge, that City Staff be authorized to order an ap:;Jraisal,
negotiate a ourchase price, purchase and prepare documents for
closinq the property at 10135 W. 38th Avenue, if necessary,
subject to final approval by Council of the purchase price; and
BE IT FURTHER RESOLVED that Jefferson County Open Space
be requested to approve the use of Open Space Funds for all of
the proper expenses involved in the appraisal and purchase of
the property.
