HomeMy WebLinkAboutResolution-1982-0791 TITLE: RESOLUTION NO. 791 Series of 1982 RESOLUTION SPECIFYING THE DUTIES OF THE CITY ATTORNEY WHEREAS, the City Attorney is employed by the City Council for the purpose of representing the City Administration as a whole, as well as the Mayor, City Administrator, City Staff and City Council Members as a whole, and WHEREAS, recent requests for actions and advice by the City Attorney are viewed by the City Council as placing the City Attorney in a compromising position between and among various Council Members, and WHEREAS, the City Council, in order to protect the City from unwarranted and unnecessary charges of conflict of interest on the part of the City Attorney, feels it is necessary to specify the duties of the City Attorney, and to whom those duties are owed; ATTEST: NOW, THEREFORE, BE IT RESOLVED that (1) The City Attorney properly prepares all legal oplnlons, ordinances, resolutions, or other legal documents requested by the City Council as a whole and/or the City Administrator; (2) Members of the City Council use discretion in making requests of the City Pttorney in matters where Council consensus or majority vote has not been previously obtained so as to avoid involving the Office of the City Attorney in factional disputes; (3) The City Attorney is directed to work promptly with the City Clerk for the purpose of drafting and submitting to the City Council, for its consideration, an ordinance establishing a comprehensive procedure covering all situations involving petitions for recall, initiative and referendum, which ordinance shall provide that the City Attorney and the City Clerk shall not be required to advise petitioners on questions of substance relating to matters which concern the petitions. (4) Nothing in this Resolution shall be construed to mean that individual members of the City Council may not discuss City related leqal matters with the City Attorney, so long as the discussions are not in the form of directives.
