TITLE: RESOLUTION AUTHORIZING THE CITY TO INITIATE CONDEMNATION
PROCEEDINGS IN ORDER TO ACQUIRE PORTIONS OF THE CP~lPBELL
PROPERTY LOCATED AT 10500 WEST 38TH AVENUE IN WHEAT RIDGE
WHEREAS, the City requires the acquisition and immediate
possession of easements on land for storm drainage along Lena Gulch;
and
WHEREAS, an appraisal for the acquisition of portions of
property at 10500 West 38th Avenue was obtained in order to
complete this project, and
WHEREAS, negotiations have failed to produce a result satis-
factory to the needs of the City in connection with this project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Wheat Ridge that the City Attorney be authorized to initiate
an action for immediate possession and condemnation of the following
parcels of land located at 10500 West 38th Avenue:
1. As permanent easement, a parcel described ln the
attached description: Lena Gulch Drainageway Acquisition No. 3.102
(Exhibit A). Said easement shall be used for storm drainage.
2. As permanent easement, a parcel described in the
attached description: Lena Gulch Drainageway Acquisition No. 3.104
(Exhibit B). Said easement shall be used for storm drainage.

A parcel of land located in the Northwest 1/4, of the Northeast 1/4 of
Section 23, Township 3 South, ~ange 6~ west of the bth P.M., Jefferson
County, Colorado, being a portion of the property described in Book 1301
Page 436, and desribed as follows;
Beginning at the Southeast corner of said described property, which point is
also the Northeast corner of Lot l'::l, I10race Heiyhts Subdivision and lies on
the West right-of-way line of l>bore Street;
thence North along said right-of-way line, 37.0 feet;
thence South 570 U4' 25" West, 55.99 feet;
thence South 890 28.5' West, 40.0 feet;
thence South, parallel to said right-of-way line, 7.0 feet to a point on the
South line of said described property which is also the North line of said
Lo t 1 9;
thence North 890 28.5' East, along said Lot line, 87.0 feet, to the Point of
Beginning, containing 1,314 square feet, or lJ.030 Acres, more or less.
Said acquisition is contained in the property described in Book 1301 Page
486 of the Jefferson County RecordS.
