TITLE: RESOLUTION AUTHORIZING THE CITY TO INITIATE CONDEMNATION
PROCEEDINGS IN ORDER TO ACQUIRE A PORTION OF THE KELLEY
PROPERTY LOCATED AT 10700 W. 38TH AVENUE IN WHEAT RIDGE
WHEREAS, the City requires the acquisition and immediate
possession of easements on land for storm drainage along Lena Gulch;
and
WHEREAS, an appraisal for the acquisition of a portion of
the property at 10700 W. 38th Avenue was obtained In order to
complete this project, and
HHEREAS, negotiations have failed to produce a result satis-
factory to the needs of the City in connection with this project;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Wheat Ridge that the City Attorney be authorized to initiate
an action for iITmediate possession and condemnation of the following
parcel of land located at 10700 West 38th Avenue.
1. As perQanent easement, a parcel described In the
attached description: Lena Gulch Drainageway Acquisition No.
3.109 (Exhibit A). Said easement shall be used for storm
drainage.
