HomeMy WebLinkAboutResolution-1983-0853 RESOLUTION NO. 853 SERIES of 1983 TITLE: RESOLUTION REFERRING TO THE REGISTERED ELECTORS OF THE CITY OF WHEAT RIDGE, COLORADO, THE QUESTION OF THE PROPOSED REPEAL OF ORDINANCE NO. 526, SERIES OF 1983, ENACTED APRIL 21, 1983, PROVIDING FOR APPROVAL OF REZONING FROM RESIDENTIAL-ONE (R-l) AND COMMERCIAL-ONE (C-l), TO PLANNED COMMERCIAL DEVELOPMENT (PCO) AND APPROVAL OF AN OUTLINE DEVELOPtvlENT PLAN FOR LAND LOCATED AT APPROXItvlATELY THE SOUTH.cAST CORNER OF KIPLING STREET AND WEST 38th AVENUE, CITY OF WHEAT RIDGE, COUNTY OF JEFFERSON, STATE OF COLORADO. WHEREAS, the City Council of the City of Wheat Ridge, Colorado, did, on April 21, 1983, enact Ordinance 526 providing for the approval of rezoning from Residential-One (R-l) and Commercial One (C-l) to Planned Commercial Development (PCD) and approval of an Outline Development Plan for land located at approximately the Southeast Corner of Kipling street and West 38th Avenue, City of Wheat Ridge, County of Jefferson, State of Colorado, and WHEREAS, pursuant to Section 6.2 of the Home Rule Charter of the City of vmeat Ridge, petitions bearing signatures of registered electors equal in amount to at least ten (10) percent of the total vote cast in the City of Wheat Ridge in the last gubernatorial election have been presented to the City Council against the going into effect of said Ordinance 526 and WHEREAS, the City Council has determined not to repeal said Ordinance 526, but has determined to submit said question to the electorate of the City of Wheat Ridge; NOW THI::REFORE, BE IT RESOLVED by the City Council of the City of Wheat Ridge, Colorado, as follows: 1. There shall be placed upon the ballot at the regular municipal election on November 8, 1983, the question of whether or not Ordinance 526 of the City of Wheat Ridge shall or shall not be repealed. 2. Pending the outcome of the election called pursuant to the preceding paragraph, Ordinance 526 is hereby suspended. In the event the result of the herein election is in favor of repeal, said Ordinance 526 shall be repealed effective November 9, 1983. In the event the result of the herein election is opposed to repeal, said Ordinance 526 shall be in force effective November 9, 1983.
