TITLE: A RESOLUTION APPROVING AS AN INTERGOVERNMENTAL AGREEMENT
AN AGREEMENT DATED MAY 21, 1984, BETWEEN THE RECREATIONAL
STORAGE AND LAND SYNDICATE, A COLORADO PARTNERSHIP, THE
CITY OF ARVADA AND THE CITY OF WHEAT RIDGE RELATING TO
THE RESPECTIVE DUTIES OF THE PARTIES IN DEVELOPMENT OF
AN AREA IN THE GENERAL LOCATION OF WEST 48TH AVENUE
BETWEEN TABOR STREET AND WARD ROAD WITHIN THE CITY OF
WHEAT RIDGE, AND AUTHORIZING THE HAYOR TO SIGN SAID
AGREEMENT.
WHEREAS, the City of Wheat Ridge is a party to a certain Agreement
dated ~1ay 21, 1984, between itself, the City of Arvada, and the
Recreational Storage and Land Syndicate, a Colorado partnership,
which Agreement sets forth certain rights and duties of the
respective parties relating to development of public improvements
within the City of Wheat Ridge;
WHEf-EAS, the staff of the City of Wheat Ridge has negotiated the
terms of said Agreement and finds that the same do not impose
burdens or obligations upon the City, but will confer benefits to
the City of Wheat Ridge;
WHEREAS, Section l4.2 of the Home Rule Charter of the City of Wheat
Ridge authorizes the City of Wheat Ridge, by Resolution, to enter
into intergovernmental agreements;
WHEREAS, because one of the parties hereto is a neighboring Home
Rule municipality, it is appropriate to treat the Agreement
described herein as an Intergovernmental Agreement and approve
the same, and authorize the Mayor to execute the same, pursuant to
Resolution as required in Section 14.2 of the Home Rule Charter of
the City of Wheat Ridge.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
WHEAT RIDGE that the Agreement dated May 2l, 1984, by and between
the Recreational Storage and Land Syndicate, a Colorado partnership,
the City of Arvada and the City of Wheat Ridge is hereby approved
pursuant to Section l4.2 of the Home Rule Charter of the City of
Wheat Ridge, and the Mayor and the City Clerk be authorized to
sign said Agreement.
