TITLE:
RESOLUTION AUTHORIZING THE MAYOR TO SiGn TI'~
INTERGOVERNMENTAL AGREEMENT ENTITL~D REQUES~
FOR PAYMENT AND CERTIFICATION OF USE OF FUNDS
FOR IMPROVEMENTS TO THE ENTRANCE ROAD AT WHEAT
RIDGE PARK.
WHEREAS, The citizens of Jefferson County nassed an
Open Space Resolution on November 7, 1972; and
WHEREAS, the citizens amen00G said Resolution on
November 4, 1980 to allow for maintenance and development of Open
Space lands and property; and
WHEREAS, the City of Wheat Ridge wishes to improve
the entrance road to Wheat Ridge Park, located at 4355 Field
Street; and
WHEREAS, this park lS used for Parks and Recreation
purposes; and
WHEREAS, it is in the best interest of the City of
Wheat Ridge to enter into the Intergovernmental Agreement which
is attached to this Resolution; and
WHEREAS, Section 14.2 of the Home Rule Charter of
the City of Wheat Ridge authorizes the City of Wheat Ridge, by
Resolution, to enter into Intergovernmental Agreements.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Wheat Ridge, that the Intergovernmental Agreement
entitled Request for Payment and Certification of Use of Funds,
attached to this Resolution be approved, and the Mayor be
authorized to sign said Intergovernmental Agreement.

REQUEST FOR PAYMENT AND
CERTIFICATION OF USE OF FUNDS
The City of Wheat Ridge hereby requests from the
Board of County Commissioners of Jefferson County, State of
Colorado, payment from the Jefferson County Open Space fund
in the amount of Forty Five Thousand Two Hundred Fifty Seven
Dollars and Twenty Cents ($45,257.20), payable 100% from its
attributable share of Open Space funds, but not to exceed
the present portion of its attributable share received
subsequent to January I, 1981.
This request constitutes a certification by the
City Council of the city of Wheat Ridge to the Board of
County Commissioners of Jefferson County that the City of
Wheat Ridge entered into a contract with Flatiron Paving on
April 8, 1985, a copy of which is attached as Exhibit "Au
for the sum of Forty Five Thousand Two Hundred Fifty Seven
Dollars and Twenty Cents ($45,257.20) for the improvements
to the entrance road at Wheat Ridge Park, located at 4355
Field Street in Wheat Ridge, all of which constitute
purposes which are authorized by the Jefferson County Open
Space Resolution as adopted by the voters on November 7,
1972 and amended on November 4, 1980.
In the event the total cost of the contract work lS
less than Forty Five Thousand Two Hundred Fifty Seven
Dollars and Twenty Cents ($45,257.20), the City of Wheat
Ridge, Colorado will refund the unexpended funds to
Jefferson County within 30 days after the final cost under
the contract is determined, to be credited to the City of
Wheat Ridge's attributable share of the Jefferson County
Open Space Fund.
In accordance with the Jefferson County Open Space
Resolution, the County or its designated representative,
may, if it so desires, audit the work papers and audit
utilized by the City of Wheat Ridge, Colorado to determine
the final cost under the contract. This certification and
request has been duly authorized by Resolution # 941
adopted by the City Council of Wheat Ridge, Colorado on
April 8, 1985, a copy of which is attached, by which the
City Council of Wheat Ridge certifies to the Board of County
Commissioners of Jefferson County that the Open Space funds
specified herein will be expended only for the purposes
sLated and authorizes the Mayor of the City of Wheat Ridge,
Colorado to sign this Request for Payment and Certification
of Use of Funds.
This certification also certifies to the Board of
County Commissioners of Jefferson County that the
facilities, programs, projects or land acquisitions upon
which the funds will be or have been expended shall be open
to the general public and the use thereof shall not be
restricted solely to the persons who reside within the City.
