TITLE: RESOLUTION PETITIONING THE COLORADO STATE PATROL TO
DESIGNATE ROUTES FOR THE TRANSPORTATION OF HAZARDOUS
MATERIALS
WHEREAS, by the adoption of Senate Bill 156 (The Hazardous
Materials Transportation Act of 1987), the Colorado General
Assembly has empowered the Colorado State Patrol to designate
routes for the transportation of hazardous materials by motor
carrier on public roads within the State, and
WHEREAS, Senate Bill 156 (at section 43-6-303(1)(a) and
(b), C.R.S.) authorizes (1) municipalities to petition the
Colorado State Patrol for such designations with respect to any
public road within the municipality's boundaries, and (2)
counties to petition the Colorado State Patrol for such
designations with respect to any public road maintained by the
county, and
WHEREAS, the City Council of Wheat Ridge has determined
that the designation of routes for the transportation of
hazardous materials within the City of Wheat Ridge is necessary
for the immediate preservation of the public health, safety and
welfare;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WHEAT RIDGE:
1. The City has undertaken certain studies and analyses
of alternative routes for transporting hazardous materials within
and through the City and has determined that certain routes are
superior to others based on the criteria as described in Senate
Bill 156 at section 43-6-302.
2. The City Council of Wheat Ridge has strong opposition
to any street or roadway which flows in a general North and South
direction through the City being designated as either a primary
or alternate hazardous material route.
3. That the Colorado State Patrol be and hereby is petitioned
to designate the following public roads within the City of Wheat
Ridge as permissible routes for the transportation of hazazrdous
materials, as defined at section 43-6-103(3), C.R.S., and
43-6-301 (2), C.R.S.:
A. Route 1:
Interstate 70 as it enters the City of Wheat
Ridge at approximately Harlan Street for
westbound traffic, and terminating at
approximately 29th Avenue at the West City
boundaries.
B. Route 2:
C. Other:
Interstate 70 as it enters the City at
approximately 29th Avenue for Eastbound traffic,
and terminating at approximately Harlan street
at the East City boundaries, excepting the
portions of Interstate 70 between approximately
Allison street and Clear Creek, which portion
belongs to the City of Arvada.
Interstate 76 both East and West bound for the
portion that transverses a very small part of
the City, as it approaches the Marshall Street
bridge. Exact boundary lines are not at this
time clearly defined.
The City of Wheat Ridge does not recognize any
other primary or alternative routes anywhere
within the Corporate limits of this
municipality.
