RESOLUTION NO. 1174
SERIES OF 1989
TITLE:
A RESOLUTION APPROVING AN INTERGOVERNMENTAL AGREEMENT
BETWEEN THE CITY OF WHEAT RIDGE AND THE CITY OF LAKEWOOD,
AND AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN SAID
INTERGOVERNMENTAL AGREEMENT.
WHEREAS, section 14.2 of the Home Rule Charter of the city of
Wheat Ridge authorizes the city council, either by Resolution or
by Ordinance, to enter into Intergovernmental Agreements as
authorized by state law;
WHEREAS, the city Council of the city of Wheat Ridge has
previously approved an appropriation not to exceed $10,000.00 to
be used for construction of a bridge over Lena Gulch between Ward
Court and vivian street near West 29th Avenue extended;
WHEREAS, completion of the construction of said bridge shall
be accomplished by the City of Lakewood, pursuant to the Agreement
attached hereto and executed by the appropriate officials of the
City of Lakewood;
WHEREAS, the City Council of the city of Wheat Ridge wishes
to approve said Intergovernmental Agreement.
NOW THEREFORE I BE IT RESOLVED by the city Council of the City
of Wheat Ridge, that
1. The Agreement attached hereto dated November 9, 1989,
between the city of Lakewood, and the city of Wheat Ridge, is
hereby adopted and approved.
2. The Mayor and the City Clerk are hereby authorized and
directed to execute said Intergovernmental Agreement.

AGREEMENT
This Agreement is made and entered into this 9 day
of November, 1989, between the CITY OF LAKEWOOD, a municipal
corporation of the state of Colorado 445 South Allison Parkway,
Lakewood, Colorado 80226, and the CITY OF WHEAT RIDGE, 7500 West
29th Avenue, Wheat Ridge, Colorado 80033.
WIT N E SSE T H:
WHEREAS, Sections 29-1-201 and 29-1-203, C.R.S., 1973
permit and encourage governments to make the most efficient use
of their powers and responsibilities by cooperating and contract-
ing with other governmental agencies to provide authorized
services; and
WHEREAS, Chester Portsmouth
within the City of Lakewood, is used

a bridge over Lena Gulch in the vicinity of 29th Avenue and Ward
Court, which access will benefit both Lakewood and Wheat Ridge;
and
WHEREAS, both Lakewood and Wheat Ridge wish to share
equally in the cost of said bridge.
NOW, THEREFORE, in consideration of the covenants and
conditions set forth herein, the parties hereto agree as follows:
1. The city of Lakewood will cause to be constructed a
bridge over Lena Gulch between Ward Court and Vivian Street near
West 29th Avenue extended.

The approximate cost of construction of said bridge
3. The City of Wheat Ridge agrees to share the cost of
the construction of said bridge on a 50-50 basis up to a limit of
$10,000.
4. Said bridge shall be completed by the City of
Lakewood by May 30, 1990. Upon completion of said bridge, half
of the construction costs, up to the amount of $10,000, will be
billed to Wheat Ridge. Wheat Ridge will reimburse the city of
Lakewood upon receipt of said bill.
